Subject: PRRA & SPOUSAL SPONSERSHIP IN PROCESS
  Please help asap,

My husband was denied refugee and were asked to go into the office June 17, 2011 at GTEC. Now we have to submit a PRRA by July 2, 2011. So we sent it in to Vancouver. Nothing "new" has come up since the refugee claim but we are trying to buy time because I applied for In Canada Sponsorship for him last July, 2010. Days later we received a letter from CIC stating ....in order to continue procssing you application in Cananda further information is required. They asked for an updated medical and family info, marriage certificate and passport info. the passport info was weird because we told them it was seized by CBSA, but thats another discussion for a later time. We did what was asked and sent it in to CIC.

Knowing PRRA has a 2% rate of success, I know his application will be denied. Do we have any ground that our sponsership application is in process? We told the officer on June 17, 2011 but he did not stale anything, he actually asked my husnabd to fill out an application for a passport since his expired......I assume to speed up the process to have him sent home once denied PRRA.

What do I do? Can I stale anymore? We are so close but yet they may make us start all over again if they send him home.

Please help, Roy?

Just to clarify my above post. May 19, 2011 we received a letter from CBSA to attend GTEC and that is when he was given the PRRA option. May 26, 2011 we received the letter from CIC wanting his updated info to continue processing our application for sponsorship. Very close, neck and neck!

Hey there ain´t no expert in the field but been reading this forum for a while.I can tell u that as ur inland sponsorship was sent before receiving ur husband´s PRRA u need to show proof of that so that the removal can be deferred

Who do I show proof of that too? And when? IS it when he is denied PRRA? What do they consider proof, the letter CIC sent us or the receipt proving we paid the application fee back 2010? Sorry I know you mentioned your not an expert but jsut so worried..... You are actually making me feel alot better and like I have a chance to keep my family together :)

Anyone who can answer please do.

Removal (may be deferred) based on Public Policy but CBSA has their interpretation of that. The Federal Courts have another!

If he came to the attention of CIC or CBSA from a Police investigation etc. they will claim he was attempting to evade removal and he is not eligible for a deferral of removal based on Public Policy of In Canada Spousals.

Now I get accused of advertising here but because you keep posting the same topic obviously you never contacted me directly. Right?

From their actions he has probably been excluded from Public Policy and you need quality assistance. Move very fast but research who you retain!

CBSA doesn´t have a different interpretation of the law. CBSA just enforces the law and the enforcement in this case likely will be a court´s decision.

There are two things here.

1- PRRA is a shot in the dark. Likely it won´t fly.
2- The deferal of his removal is not an easy thing to do, at this point CBSA is going to try to exclude him out of the public policy and once that is done, the court can´t really do anything and CBSA will enforce his removal.

What people need to understand is that a spousal application IN doesn´t prevent a deportation and does not automatically defers someone´s removal.

You should withdraw the application, he should leave Canada. Then you can sponsor him from outside of Canada and then he can legally immigrate as a family member so both of you can live here forver together.

Did you read this DocD your saying that the CBSA Officer was right and the Federal Court Judge was wrong???????

The Federal Court Judge issued a stay of removal because of a CBSA Officers interpretation of the Law. Okay CBSA only enforces laws but they have to understand the Law to enforce it correctly.

I am not a judge. I am just giving you the two likely possible scenarios.

You are talking about one deferal out of how many removals?
The stats are low. Meaning the chances are slim.

Thanks for all your responses. I have made the decsiiosn to keep going ahead witht he sponsership. Fingers crossed they get back to us before the PRRA rejection does. I called CIC on Thursday June 30 and they had received his updated medical:), just the marriages certificate and updated family info was not in the system yet. I fedex it so I know it arrived there. I figure its too late to withdrawl for a refund so might as well keep at it. I will definately take your adive and ask for a stay of removal when the PRRA comes back rejected.

Hey,
I got marry on 28th july and and the sponser application after two days on 30th.It received by case processing office on 2nd of august.And i received prra letter on 29july day after my marriage which has been issed on just day before my marriage on 27th.someone told me that if u get marry and file your case within 7 days after your prra letter issue date then they consider your sponsership application.Is this true or not?Or dose it makes any difference in my case or my in my prra.
