Subject: Appeal allowed - ARC Expert Advice needed
  Anybody can give me advise would be greatly appreciated.

April 2011 Sponsorship appeal allowed under H&C grounds. He had 2 criminal offense on year 1999, failed to serve his sentence of 1 yr. under their criminal code, it became exempted after 10 yrs. (whether served or not).Now he was able to get a clear police clearance of this country committed with exact form parts A,B,C,D,E also clear. Not qualifed for rehabiliation since not serve the sentence as per CAIPS Notes. IO believe marriage is bonafide & appeal won under H&C for best interest of the child (1) involved.

Now, ARC submitted with the rest of updated forms a week after Visa office start re-processing again the application. Here are my questions:
1. If criminality was overcome at the appeal, is it also likely approve his ARC application?
2. Husband lived in Canada for 10 years trying to apply for conventional refugee, federal court, H&C, PRRA, all failed. Do they have to dig everything about his previous application way back 10 when he initially apply refugee?

I thought appeal won was the end of the tunnel but I am afraid that they may find fault based on his previous refugee files. I never feel happy since this all started and it affects me, my son & my husband and my work. My son is asking me " I want daddy" financially I am struggling with no relatives here in Canada to support except me, myself & I.

Hungary. My husband is in Hungary since 2009 & free. The Governement of Hungary doesn´t even want my husband to serve the sentence anymore since it´s already expired.

Convicting people in their absence is a normal practice in Hungary.

but it´s not normal to the eyes of the Canadian IO and they are very strict even for an offense of someone who stole candy at the store. :(
