Subject: PRRA and H&C handle by the same officer?
I have both applications in since last year. I applied for h&c in September 2010 and PRRA in December 2010. My question is, is it the same officer that will handle both application?. Since the new riles and regulation governing h&c now states that ´´Risk´´ will no longer be a factor in h&c applications. My PRRA will be 5 months this month ending, and my h&c file was transfered to Vancouver for further assessment that the office may contact me.Anyone with the same timeline with me?.I´ve kept updating my files and hoping for the best. Am so scared now because my PRRA application is almost 5months, and i heard that the longest it could go is 6 months.Do i get decision prior the same time, or it will be handle by different officer. Please i need some information on this issue.

What you hear and what is fact are two totally different things.

Some PRRA´s are not decided on for years.

H&C are based on common sense with unusual, undeserved or disproportionate hardship while the PRRA is cruel punishment and they see that as different. Why???? I don´t see a major difference.

Good thing you have een updating your H&C and I hope you did not mention your Refugee claim issues in your H&C. Refugee issues are decided by the IRB and H&C issues are decided by an Immigration Officer who has NO say about refugee issues.

If your denied the better the H&C and the longer it has been in increases your chances at Federal court if you wish to go that route.

The manual(ip05-eng) has been rewritten and it´s bigger than ever.

Please refer to the Section 8.2 and 8.5 for comprehensive information.

Thanks (in reply to: PRRA and H&C handle by the same officer?)
Thanks very much for your quick response. @Roy, i did update not too long and never mentioned anything in refugee story.I called the call center and they said that they both go hand in hand. Those people can easily derailed applicants.I quiet understand that so many pressure, but i think i just have to relax and be myself. The guy that filled my h&c is one of their former case processing office but not retired. He said if my prra comes out negative, them we´ll seek for stay of removal for them to make decision on the h&c. So my hands are tight and crossed till then. I have a positive feelings that it will be fine with us in this country.
You guys should just keep updating your files as Roy had said earlier. It is the best. The more you update, the better for you. Roy please keep us update on any information you think might help the seekers like us...laughing and thanks for your help

PRRA usually trigger between anytime you were rejected. I believed that the system has been changed. Prra was usually served to you at your local office, after CIC the correspondence that u were rejected. The system now is that, you´ll still be served PRRA by your local office, but the case would be determined from Vancouver. Vancouver (BRO) coordinates the whole paper work. Then you´ll be invited to come to your local office. You´ll be served PRRA application and you´ll singed. Then they will send it back to Vancouver for assessment. Then, Vancouver office will then forward it to any of the three BRO offices. One is in Montreal, another in Niagara falls and the last one in Toronto. So I´ll suggest you wait for them to contact you. While ding that, make sure you secure a reputable immigration lawyer to help you further on the matter.
