Subject: Defending a Client - War with CIC/CBSA

I spoke to a colleague of mine who I respect this week after one of my clients was treated badly in my opinion by a CBSA Officer.

Mr. Guidy Mamann said to me Roy they may have won that particular battle but you need to focus on the war! Never a more logical statement said!

I am referring to an Un-Wed Mother named Kelly Wang which had her situation covered in the media. Ms. Wang was a DIY person until everything went KA-BOOM!

Ms. Wang wrote her own H&C and PRRA submissions. Now of course I would not recommend that but she did almost, okay.

Ms. Wang has a child out of Wed-Lock which is against the Law in China. She did not put everything into her applications that she should of but she clearly identified the reasons for cruel and unusual punishment plus Unusual, Undeserved & Disproportionate Hardship to the Officer in Niagara Falls CIC. That Officer incorrectly assessed her as if she had three children or above Quota children.

By the time she came to me going to Federal Court was not an option so I tried common sense. I sent in a second PRRA and H&C. H&C has since been transferred to Vancouver. Nothing not a peep!

She was told to go to the Chinese Consulate in Toronto and apply for a Visa for her Canadian child and bring back a ticket. She was told at the Chinese Consulate since her child´s passport which CBSA had a copy of had only five months duration left on it she would have to get it renewed.

I told her not to purchase a NON-REFUNDABLE ticket for herself because we needed to renew the babies Canadian passport.

When we went to CBSA at 6900 Airport Rd. to inform the Officer that particular Officer hit the roof. She gave Ms. Wang 72 hours to renew the passport and booked her and her daughter on a plane for March 30th 2011 even though her baby may not be able to get a passport in that time.

Both CIC and CBSA should be ashamed that they are sending a Canadian child to a country that will never give her any status as a citizen etc. Not allow the Canadian child to go to school, work, marry travel etc.

Worse getting the passport renewed while over there five years from now will be impossible for the mother to achieve.

Any Counsel worth anything needs to be connected to others when things start going not they way they expected. Any client when in a desperate situation needs a counsel capable of going to war.

I know Ms. Wang deserves better from Canadian authorities. Do you think my advice about not getting a NON-REFUNDABLE ticket was the right advice considering she is a single mother on a fixed income?

I enjoy going to war for real good parents and for Canadian children who do not have a voice. If others can be accepted based on the same circumstances I say, why not Ms. Wang?

IMHO, immigration consultants are mostly scam artists. You cam complete the forms yourself, and if it gets complicated, you need a lawyer not a consultant.

As for this case, the Canadian government doesnt owe Ms. Wang anything. This is not a war, it´s a case of another economic migrant trying to jump the line.

If everyone can DIY then why does this forum exist?

Ms. Wang is an Un-Wed Mother that will be fined six times the disposable income JUST for having a child out of wedlock. Approximately $140,000.00 Canadian.

The Canadian child TANYA will not be allowed to attend state funded schools, work, marry, travel or obtain any Chinese citizenship.

Compassion has to be common sense so you believe Ms. Wang is jumping ahead of you, you´re &)((*^%!

Ms. Wang did her PRRA and H&C applications by herself and was wrongfully assessed by Niagara Falls CIC. Yet you recommend DIY!

Now if there were ONE Immigration Lawyer who knew more about the Un-Wed Mother situation than I do I would agree with you but there isn´t. Ms. Wang came to me because of my passion and knowledge on the subject plus my proven success rate.

Is there Consultants and Lawyers who are scam artists, YES!

Has Ms. Wang paid anything for all the time I have spent with her in the last two weeks attending different offices, NO!

If the representative can prove they have won similar cases then they are worth every penny. If they can´t don´t hire them!

Roy , after reading your this thread , i am very much worried about my case. My unprofessional representative filed H & C on my behalf and put risk in the application and now is being processed at some GTA office. I don´t know what will be the outcome from my combined h & C + PRRA applications?

Maybe Ms. Wang should have thought of the consequences before she decided to bring this child into the world? Was she that certain that she could stay in Canada when in fact she did not have the qualications?

Mainland Chinese are known to scam the immigration system, at all cost!

I was at a dinner recently and heard the the story of a couple from mainland China where the husband came to Canada and applied for refugee claiming to be oppressed because he had one too many children, above the quota when in fact he only had 1 child so of course he fails the interview because he could not provide facts on the second phantom child. He stays despite a removal order and his wife joins him via human smugglers where she joins a tour for Thailand where visa is not required. Meets the smugglers at the transit lounge in Hong Kong, swaps boarding pass and gets her fake passport and board the flight for Vancouver. Once on the plane, she destroys the fake passport. Lands in Vancouver and claims refugee. Her claim has been accepted initially and now she is pregnent, working under the table at a restaurant and will have the Canadian taxpayers look after her prenatal care costs as well as delivery cost in addition to the social benefits that she is receivng on a monthly basis and we should shed tears for these people?

Please take off your rosy glasses and get a dose of reality about these fraudsters!

Why does it matter if there is a name or anonymous is used in this forum? And so what if you post "Moe" as your name how do I know that´s really you name but most importantly why would I care? The point being made is that Roy´s client is supposedly trated badly by CIC / CBSA but how did Ms. Wang get into this situation in the first place?

The story of the couple above is just one of thousands that happens most likely daily at Vancouver International Airport. Why are we the taxpayers stuck with these unwanted bills?

So to answer your qustion, NO its obvious that I am not one of THEM!

Your tax money goes to other causes such as environment assessment, municipal garbage pick-ups and Canadian-born children´s education.

My tax, however, goes to those fraudulent claimants.

Mainland Chinese hmmm sounds more then just discrimination. Sounds to me your racist!!!! So Chinese from Hong Kong are better people?

What difference does it make if the condom broke or she bought her sperm at the local sperm bank or worse the man said don´t worry I´ll......

Ms. Wang qualifies because it is common sense to show compassion when their is unusual, undeserved or disproportionate hardship.

Any other single mother from any other country can go home with their Canadian born child and obtain their countries citizenship for their Canadian born child. Look up the Nationality Law of China article 5!

China signed the UN Convention on the rights of the child yet do not allow their citizens children who were born in one province to go to a school in another if their parents have moved for employment.

Why should any woman in Canada who gets pregnant while not married choose to keep the fetus? Everyone in Canada is to be treated equally and that includes mainland Chinese refugee claimants.

You don´t know maybe Mr. Smooth talker was talking about marriage, family, house, etc. etc. or was lied to her.

Get back to the issue Ms. Wang has Unusual, Undeserved and Disproportionate Hardship if removed from Canada.
