Subject: Applied in 2004
  Hi - I have applied for immigration in skilled worker category in 2004 from India. they asked for updates from us in 2009 and then again there is silence. I cannot apply in the new categories but waiting for so long has been frustrating and my dependents lives are on hold as they do want to come to Canada but how much more can they keep studying ( one of the requirements).....if they stop studying then would they not qualify? when will the backlog get cleared?

Hi,

If you can´t re apply in new categories, the only option available to you is TO WAIT. So, be patient. Prbably, you may get your PR next year.

Sandeep, how can you make such a prediction? Pre-2008 applications are being used as filler. You know that. This could take a very long time.

Sham, I would seriously look at whether Canada is worth putting your life on hold for such a long time. 1) there is no guarantee you will be approved 2)there is no guarantee you will find work and 3) there is no guarantee you will be happy.

If life is acceptable and you have opportunity where you are... I would consider spending your energy making the best of what you have rather than waiting and hoping for something that may never materialize.

Sharon, what does "Pre-2008 applications are being used as filler" mean. We had got the application received letter in Sept 2004 and had send the updated documents in Nov 2008. We had also applied under Skilled category. Pleas do explain the filler part. Thanks

I have a world renowned Scientist as a client who has created a company with a First Nations band in Canada to turn waste/garbage into energy.

His FSW application is IN PROCESS at the Canadian Embassy in Berlin, Germany. He has a contract for four new facilities in Canada one to start in BC this summer.

They have plants running in Scotland and others in Turkey and Sri Lanka etc.

They are also turning plastic bottles back into oil etc. etc. He has his credentials recognized by the Canadian Scientific community and he waits, and waits!

Yet his file is IN PROCESS bending background checks. That is all the Visa Post will state. I asked CIC Embassy in Berlin if he should withdraw and submit a new application through the Central Intake Office in Sydney, NS.

No opinion from CIC.

I have recommended he start a new FSW Application as a Ministerial Instructions NOC application but he thinks he should wait.

He is worth hundreds of thousands and soon to be millions and employs many already in Canada yet he waits.

Some times certain individuals are penny wise and pound foolish. See he has already paid $550.00 FSW processing fee three and a half years ago. He thinks that he has already paid and that CIC has an obligation to process his FSW application.

He has no idea how long the wait will be and CIC has not said anything other then that they are doing background checks.

My advice to withdraw and start a new Ministerial Instructions Application has fallen on deaf ears because he believes like Sandeep believes which to me is so illogical that he should wait. Like I imagine the feeling and plan to live life to the Max when I win the Lottery.

What gets me angry is this guy will soon give up totally on Canada and then what will Toronto and other major cities due with their garbage.

Oh I forgot these cities can purchase their waste to energy plants from Americans instead of First Nation businesses people.

Wait great advice!

what does filler mean... well, they take all the applications that were submitted under the new rules for the year. If there is any remaining quota they will go back and try to use the older applications to fill the numbers they have agreed to take each year.

This was the only legal way CIC could change the rules withoug getting sued. You will still be processed - just no idea when. The truth is, depending on your skills - the economy has changed so much in 6 years that there may not be any work for you once you get here. That is the main reason for the rule change in the first place. Make sure that people who are coming to Canada have a reasonable chance of finding work.
