Subject: PR Card Out of Status
  Hi,

I got my PR in 2006 and landed into Canada, stayed for a month and returned to sell off my house/car, quit my job and draw out my bank savings.

I had a bit of downturn, when I met with accident and broke my right arm in three places (and my front tooth).

It has taken four years of physiotherapy and strength training to get my arm fighting fit. Now I can do everything I could before the accident.

However, this was a setback for me and delayed all my other plans of selling the assets; when I was finally done with all of it, I realised that I was no longer in-status.

Now, in February 2011, would it be a good idea to go back to Canada; meaning thereby that will they be congenial enough to understand/care and allow me a second chance?

I suppose there is no way to be really sure of it, still, I´d value anyone´s learned opinion.

Come back to Canada before PR card expires and explain this situation to the officer at Central office and stay for the next two years and apply for PR renewal.

Well let us split 2006 in half and consider you got your PR status in Canada on June 1st 2006

You departed Canada on July 1st 2006 on Canada day after being in Canada for the whole month of June.

AWWWW you broke your tooth so you had to stay out of Canada for FOUR AND A HALF YEARS.

Because you broke your tooth and your arm was in a cast you could not sell your property and other assets for FOUR AND A HALF YEARS. Go ahead tell that Fish story.

Well Anonymous 233.201.58 feels the 4 1/2 years of pain for your broken tooth and he thinks the CBSA Officer at the port of entry will understand as well the CIC Officer when considering sending you to a Residency Appeal of your PR status but I don´t!!!

What does DocD think???

Anonymous 233.201.58 advice is not right, revoking or keeping his status is not a decision that the CBSA officer can make at the port of entry. Vibahv doesn´t meet the minimum residency requirements to maintain his status as a PR at this point. That is a fact.

Vibhav will be refered to secondary and there the officer is going to advice you on what CIC office to go to deal with your Residency Appeal.

Then CIC will its part.

Hey Roy,

Thanks for the advice. More than your words, I admire your attitude. You seem like some loser lawyer trying to impress people to ask you for some advice and maybe you could earn a few bucks that way.Had any luck lately? Or maybe I am wrong. But you certainly seem to be hounding the place and making all your smart-aleck comments like you have entire CIC institution eating out of your expert hands.

My ´fish story´ is real. I am sticking to it. Like I said, no one can predict what will happen. In the worst case scenario, I will withdraw my settlement funds from Scotiabank and leave Canada.

No need to get so excited Roy. You sound pretty silly that way.

I was never excited I was just frustrated at your poor attempt to pull the wool over others eyes into thinking you woke up one day, FOUR AND A HALF YEARS LATER when you had finally sold your assets and Quote " when I was finally done with all of it, I realised that I was no longer in-status!" Dah

You forgot about maintaining your resident status for FOUR AND A HALF YEARS and you want compassion?????

You want to know if CBSA and CIC Officers will be Quote ---congenial enough to understand/care and allow me a second chance---- about a broken arm and tooth?

***I´m not trying to impress anyone just trying to prevent people like you taking the (wrong advice) of Anonymous 233.201.58 and ending up locked up in detention when you come in claiming your fish story (broken tooth-arm story).

Come up with a far better story and be prepared to hire someone who can sell H&C factors at your residency appeal.

A BETTER FISH STORY COULD PREVENT YOU BEING THROWN IN JAIL OR DETENTION BUT WILL DEFINATELY INCREASE YOUR CHANCES OF GETTING YOUR RESIDENCY STATUS BACK.
