| Subject: H&C and Removal Order !!! WTF ? |

Please explain and clarify when Removal Order is put on hold when H&C is claimed.
There are is an option to put Removal Order by the officer, and the officer can decide that claimant must go back to country of origin.
Moreover, I found contradictory information on H&C and Removal Order.
One says that after H&C claimant is strongly advised not to leave Canada.
The other says that claimant must go back home and wait for decission on his case there.
Please explain.

Until your approved stage one based on an H&C application the removal process continues. Having an H&C application in process does not prevent your removal.
If you have a stay application with the Federal Court or a In Canada Spousal Application in process will defer your removal.
Even then there are circumstances when a spousal sponsorship application will not defer your removal.

Q: One says that after H&C claimant is strongly advised not to leave Canada.
A: This applies to a person who has been approved in principle, the first stage of H&C. "Because if you leave Canada, there is no guarantee that you´ll be re-admitted so that you continue with the application".
Q: The other says that claimant must go back home and wait for decision on his case there.
A: This applies to a person who has submitted H&C after being given the specified removal date to leave Canada.
"We will continue to process your application and we will notify you of the decision on your application in writing."
Your removal order is stayed when your H&C has been approved subject to your meeting the statutory requirements of the Act; that is, the first stage, approved in principle.
