Subject: H&C grounds steps
  Hello all,
We have submitted PR application for my grandmother on H&C grounds in August 2009. On January 29, 2010 we received a letter from CIC-Vergeville stating our case was transferred to Mississauga. However we haven’t heard from that office since.
I am confused with 2 steps… Correct me if I am wrong, we are now at the 2nd step of the process which takes 15 months (My guess the 1st step is Vegreville and the 2nd step is your local office)

Vegreville is the initial screening process to see if everything is in order.

The first step is that the officer at the local immigration officer makes a decision, approved in principal.

The second step is all the rest, medical, security, and police certificate and paying the right of PR and photos, etc.

You are in for the first step at the local IMM centre.

I apply in July 2009 and I receive a letter in Dec 09 saying that my application were transfer to Etobicoke and I haven´t heard anything either.What I would like to know is this normal?

The first step of H&C can take up to 1 to 2 years.

Stop focusing on the timeline and start focusing on the Unusual, Undeserved or Disproportionate Hardship you face.

Your refugee claim reasons have nothing to do with H&C factors.

Read the IP 5 H&C manual.

Go to www.cic.gc.ca and search operational manuals, Inland Processing IP5

Thanks for answering my question. I did not apply for refugee status. My Lawyer advice my husband and I that its best for me to apply for H&C grounds.I have 2 Canadian kids and am married

I understand that Canadian Kids can be a hardship but they are not undeserved, unusual or disproportionate in the vast majority of situations.

I am not being critical of your Lawyer without knowing all the details. Something does not seem correct.

I appriciate any sugestion.
What do you think is best? Should I just wait or is there anything that my Lawyer can do to speed up the process.

Stage one is approval in principle and stage two is background checks regarding admissability.
