Silly question of course persons have been approved under H&C from Etobicoke CIC.

It is far easier to say no but when an H&C applicant submits quality evidence that they are affected by unusual, undeserved or disproportionate hardship a positive decision is forthcoming.

CIC Officers have to say NO when lack of H&C factors are presented.

Our clients have been very successful because we try to put forward common sense issues. The problem now is that most of our clients H&C applications are now being sent to Vancouver CIC.

sorry, i mean H & C with risk. i heard that one officer handle both files the H & C and PRRA! and that officer is only risk expert.

A PRRA officer on his or her

DECISION AND RATIONALE on H & C

The applicant is seeking an exemption from the in-Canada selection criteria ( and the requirement to not be inadmissible) based on humanitarian and compassionate or public policy considerations to facilitate precessing of the application for PR from within Canada. The applicant bears the onus of satisfying the decision-maker that their personal circumstances are such that the hardship of having to obtain a PR visa from outside Canada in the normal manner would be i) unusual and undeserved or ii) disproportionate.


If the PRRA officer allows the application with exemption.

Another letter goes:

It has been determined that you are a person with respect to whom an application for PR has been approved subject to your meeting the statutory requirements of the IRP Act. As a result, no purpose would be served by continuing to consider your PRRA application. This notice is to inform you that your PRRA file has been closed.


If the PRRA officer makes a positive decision on your H&C and you are landed as PR, there may be a surprise.

It does not show on your confirmation of PR, but if you apply for a provincial health care coverage such as OHIP for the first time, your status may show as Protected Person on the provincial health care application, overriding the 3 month mandatory waiting period.

Good day Roy or any other relevant Contributors,

I have a quick question to ask you. First,my refuge application was denied in 2008. Prompt to that, my lawyer defer my removal with the process of an appeal which i won in 2009. I was schedule to attend another interview in April, 2010. The member was very inquisitive. He made a good point though, saying that i never upgrade or make any changes on my PIF,he went ahead to dis-believed my story. My wife filled for me in 2009, and later withdrawn the application in August 2010.I was left with H&.At this point i was so confused, and i had to change my lawyer.I have my PRRA already in process which i put in last year December. My H&C was transfered to Vancouver local office this year January.I called the CIC and they said the Vancouver office are sharing the work load with Etobicoke. I just want to know Vancouver time line or if they have backlog. Am so confuse now and this is really affecting my studies. I have a full time job and been here since 2006.
Any hope Mr. Roy?

hi,i am wondering how long does it take to receive a repsonse from immigration for h&c in etobicoke.i received a letter from alberta in 2008 stating my file has been sent to etobicoke and now its almost 2 and half years and i have not heard from them.what should i do?do i call them or how long is the process. everyone keep saying 2 years. thanks for ur advice and have a great day.

hi,i recieve a notice from immigration canada in alberta last july 2011 that my application for Permanent resident and open permit is already transfer in local immigration canada in etobicoke,and until now i dont have hear any news regarding my application whats going on.and i dont know about my status here in canada,i dont have any documents holding right now and i dont have money to pay for the lawyer to help my application because i cannot work what can i do in the future???
