Subject: A desparate father's plea!
  Hello, let me get straight to the point. We were refused our refugee claim and failed our PRRA as well. Much to our surprise, our strong case was (I feel) unjustly reviewed by the IRB and CBSA. I had evidence of my past abduction and torture (well documented even in the web!) by a local police in our country that is well known and publicly defended by both the ex president and a senator. Even then, we still were denied even after showing them of how corrupt the country is. But still, the member said that "I may seek protection from the government". The same government that had me abducted and wrongfully accused! I have proof that I was innocent but I guess that didn´t matter as to their eyes, I am not a refugee. The CBSA was also, in my opinion, insensitive! They see no reason for me to worry as being deported back to the country is what they think is necessary. I have told them that these people are connected with our embassy and them filing for our travel documents probably have prompted an "alert" to my captors. I seriously fear for the safety of my wife and my children! I could care less if it was only me but my children and my wife have been threatened to be tortured, raped and killed! I have no more money to spend as I am the only one providing for my family! I know I have to leave the country but is there a slight chance that I may still fight this? I cannot afford to be deported as I will surely face tremendous amounts of hardship. I have no family left in our country and my wife´s family have already disowned us for putting them at risk! If anyone out there can help, please let me know. My children are Samantha 11yrs old and my boy Ulrich age 8yrs old. I have proof that everything I claim is true! I thought I was doing the right thing by exposing the bad element in our country. I even reported all the wrong doing to the proper authorities but in the end, it all came back to me! Please, for my children´s sake, help us!

To anyone out there willing to help, please advise me of what to do! I am desperate and will do anything just to escape the torture and death that we will surely face when deported!

Well like on Dragons Den last night my "BS" meter is going through the roof reading this crap this morning.

So you lost your refugee claim and you lost your PRRA and CBSA said thank you for coming in to get your results, -- have a nice day! Not likely!!!

Get us a plane ticket you got two days to bring one in and you must fly directly home or you can go through this country etc. etc. or else we will buy you one. TWO DAYS!

Lets look at the story.

You came with no money from the Philippines and made a refugee claim and Legal Aid refused to pay for any Legal Assistance because of the story.

You hire a Lawyer and he gets upset because you fail to meet his retainer agreement and pay him on time.

You hence blame the Lawyer for failing to submit evidence in a timely fashion. You could of submitted evidence since it probably was two years from the time you arrived until your hearing.

You claim in your blog that you believe in December after submitting a PRRA application your far away from deportation. Yet you later claim CBSA informed you to prepare yourself for removal and that the chances for a positive decision is slim! Which is it?

So you made a refugee claim stating you were fleeing (prosecution) not persecution - what did you expect?

If Tom, Dick or Harry went to Sweden and claimed refugee status because the police caught them with three kilos of Heroin each, do you think Sweden would grant them refugee status?

Canada Revenue Agency is punishing you for working two jobs.
Your December rent will not be paid.
You have contemplated suicide.
You got an Insurance settlement from a HIT & RUN accident, hmmmm.

Yet you bought a car without finacing it and you can´t feed your family!

Compassion has to be based on common sense. You need unusual, undeserved or disproportionate hardship.

What I see is that no government agency believed a word you said from day one. Not Legal Aid, your own Lawyer, the IRB, CBSA etc. You blame everyone else for your problems but yourself.

Now you want me and others to believe that after receiving a negative PRRA they told you thank you for coming in to pick up your negative PRRA decision. They did not tell you to bring in a ticket for your whole families removal by a certain date or they would pay for your families flight they just said "Have a Nice Day!

Then the final nail in your coffin is when I read that Canada my country only wants to make money from Refugee claimants. You come here hiding your wealth, use the system costing Canadian tax payers thousands and all Canada wants is to make money from Refugee claimants.

You claimed that you had all kinds of expensive toys Quote "I had a very hot wife, two great kids, several Ducati motorcycles, an MBZ SLK and an S-class for me and an MBZ ML and the E-class for the wife, a multi million dollar condo, a vacation home in the hills next to a golf course, $30,000 watches, $1,200 suits, contacts that could provide me with just about anything I wished for and a very successful business. I even employed a few useless relatives just to keep up with the appearance! UnQuote

But when you arrived here you had no money! WHY?????

I´ll say this before DocD says it.

Desperate Father,

I think Roy said it all.

I don´t believe your story either, there are too many things that just don´t add.

The first thing to do is accept the idea that nobody in this country is believing you and you are not getting any free lunch from CRA/CBSA/CIC/even your ex-lawyer and whoever else is after you.

For your own sake, leave the country. Otherwise at some point in time, it is going to be very nasty for everyone to be detained, put in detention and deported back to your homeland.

There is nothing else to do, this is the end of the road.

I am pretty sure that at this point there is got to be a deportation order againt you.

You think is hard to survive with a work permit, try to raise a family without one.

Dear Mr. Roy and DocD,

Well thanks anyways for taking the time to review my plea. I´m sorry that you think this is all just a story. No excuses, but I think everyone could´ve and should´ve taken the time to realize that not all stories that sound too good to be true are just stories! I wish that I was just making this up, for my children´s sake.

I think these comments just shows that the culture clash is evident and that a person just trying to get ahead ends in the end. I hope that one day I could prove myself to anyone out there willing to really listen and probe the factual datas of my case. I guess it just shows how unclear I have been with my story and that I will be facing these dilemmas by myself as usual.

I hope that all will be well for all of us and that horror stories similar to mine may one day be recognized and not questioned for it´s validity even when more than enough legal proof had been submitted. Maybe one day, someone like me can actually be taken seriously and not considered a great story teller! Thanks again for the time and have a pleasant day!

12 weeks ago, a person could have arrived in Canada from Tunisia claiming refugee status and CIC would have laughed at them. Today, I think the reaction would be very different and tomorrow, CIC would probably ask that person why they waited so long to escape.

We should not be so fast to accuse people of lying.

Government employees are trained to listen to the story and verify it with the evidence that is provided. No more no less. Any personal feelings and tiers add very little value to it.

The story has to match the evidence and it does have to make sense in order to make a final decision whether is a yey or nay.

I don´t know the details of his personal situation, I don´t have them nor I want them.

However, I am giving my opinion based on what I´m reading and I am putting together a sequence of events based on the procedures and legislation and there are a couple of things that just don´t make any sense.

I don´t know if he is lying or not. I just don´t believe him based on the story I read alone.

Greetings,

Just to clear up the air, I have not included a lot of details pertaining to my case. I felt that getting to the actual problem that were facing now is what I am trying to get a solution for. Most of the story I have written in that blog also had to be edited, if not, I think people trying to read it will just fall asleep somewhere in the middle of it. I have been asked in numerous occasions why I don´t have any money. It´s quite simple really, the corruption in our country is so vagrant that even a person in the lowest form of government must be bribed for something. It is actually considered by many (including Canadians) as a standard form of business practice in Manila.

I could go on and on about this but the true dilemma I am facing now is being deported back to the country which tried and failed to prosecute me for crimes I have not committed. Double jeopardy is not uncommon and is what I am facing. They have recently (2009) issued another warrant for my arrest after the CIC had made an inquiry to my case from the Philippine courts. The courts even pleaded to the Canadian embassy to provide them of my whereabouts and a reward for the dead! The Canadian embassy even submitted a copy of the fresh warrant that clearly indicates the same exact cases that I have resolved, beaten and quashed in the past. So to answer the question of where the money is, most of it went to the lawyers, the cops, the judges, and everyone else I could pay to help speed the process of my Habeas Corpus. A big chunk of it was also stolen by the bank manager and we have evidential proof from the local Bureau of Investigations in the Philippines that the manager and my uncle had withdrawn monies from the account. The Canadian embassy also had certified letters which they submitted that "I" initially reported the syndicate to all the embassies including the police, national investigators, etc. I even went as far as getting my abductors captured and jailed for serious illegal detention and the organized syndicate disbanded. The President of the country (at one point) even ordered for these men to be sought and prosecuted but her husband and a high powered Senator intervened and somehow got the leader out of the country before he was captured. This was documented by major broadcasting networks in our country!

But I guess our fate had been rested in the hands of one person. A person that like Mr. Roy and DocD, mis-interpreted my plea as a fabrication and quick to judge my case for the LACK OF key details that I did not wish to disclaim in this forum at first. I don´t blame them though, even I would think the same if I were in their shoes and read this story on the internet. No grudges held and I truly wish the best to everyone in this forum. I thank Mr. Roy and DocD for giving me fresh ideas about how the CIC may have viewed my application. Maybe I can re-arrange and somehow write down as much detail as possible with time frames, names, location, etc. for our Federal Inquiry (?) to the PRRA decision. Pardon me but I had failed to mention a thing or two about the "properties". Our condos, lands, automobiles, motorcycles and other valuables had been sequestered by the government and liquidated to "compensate" the complainants. The same complainants that are still filing cases on me! The same complainants who claims that they have never been compensated yet for their losses.

So I hope this shed some light as to the urgency in my tone. I do not have much money to fight the system in our country. I fear that retribution will come in a form where my wife and children would suffer greatly. It has happened before and is still happening to this very minute. These people after me are controlled by very powerful groups who wants nothing more than for me to suffer for killing their "milking cow". So please, before I get judged again, we only wish to be shown some ways for us to fight to remain in Canada. Not by choice but by necessity for my family´s sake!

I agree the courts in certain countries are less then fair and in certain countries it takes years to get your day in court which probably will not serve Justice.

But this story is sooooo full of holes it is rediculous to show a shred of compassion.

Ahhh the money finally the money is some what clarified LOL

You got your family into Canada so you had money that was not taken by the state. You flew to Canada with your complete family at a cost of????? Worse case scenario you came by boat to visit Sharon in BC.

Now your filing a Federal Inquiry of your negative PRRA assessment which will cost an average of $6,500.00 and your soooooooo poor that you can´t feed your family or pay your rent!

Again Compassion has to be common sense.

Go home apply abroad as a FSW based on your qualifications and seek authorization to return.

Hi Mr. Roy,

It appears that you had developed an extreme biasness towards my claims and that I respect. It is in fact my obligation to prove that we are (in deed) in need of great assistance. As for the appeal, a very generous group of lawyers had been offered to me by an organization in Vancouver known as VAST. These lawyers agreed to perform the task "Pro Bono" including the fees that a process such as this could/would generate.

I am very grateful for that but we have been told that two negative decisions (for however little the reasons may be) is a far greater than having to prove my case initially. But they also stated that my case has a slightly better chance as the initial denial has some vague description of why our claims were denied. The PRRA decision was solely based on the IRB decision that it would be not too difficult (as they claim) to be reversed.

However, trying to initiate the process could take some time as there are supposedly numerous other cases pending and that we only had a limited amount of time to put a stop on the deportation order. I have also discusses a possible flee scenario if the case may discover some delays that might jeopardize our retention from Canada. I was advised that maybe seeking shelter from a church or something similar would have to be necessary but they also told me that this will greatly strain the patience of my family. But we have to do what we have to do.

So with that said, I thank each and everyone here that have contributed to my thought process and wish everyone the best. Thanks again for all those who prayed for us and wished us well. And to Mr. Roy, I truly do respect your opinion and judgement even though it appeared totally against us. I know for a fact that you are highly regarding with these types of matters and for that, I thank you for taking the time to devote some opinions in this thread. I truly do appreciate it and may God bless us all.
