Subject: Girlfriend moving with me to Canada?
  Hi guys,

Hope you all had a great new year´s. I am a Canadian permanent resident, who has received permanent resident status having being sponsored by my parents (at the time of my application I was below 18). I have never lived in Canada other than the first time I landed in Canada as a landed immigrant, and have spent only 2 weeks living there. After leaving Canada, I have lived in my home country, and now risk losing my permanent status if I do not return to canada by the end of this year (as a permanent resident must live in Canada for two years out of every five or risk losing that status).

Now, I have been in a serious relationship with my girlfriend for 3 years, we´ve been living together for 3 years too, renting a house together etc. But we have yet to marry as I wish to put off marriage until I am older when my career is stable, made some money, and then we´ll have a grand one to tie the knot. But me and her cannot bear to be apart, and in fact, I have put off living in Canada until now, as I do not want to leave her alone in my home country, my parents do not know this, and I have been making up excuses to prolong my stay in my home country, but now my time is running out. Now I am faced with either moving to Canada or risk losing my permanent resident status, which I do not want to lose. I wish to take her to canada with me, and we´ll see each other day after day, like we do now.

How would my simple wish be fulfilled?

she can come on her own merits to Canada as a visitor and hope she can renew her visa after 6 months. Don´t count on it.

You cannot sponsor her as you must be living and working in Canada to do so. Likely you would need to marry her or CIC will look at the out of country common law situation and think the sponsorship is simply for her to gain Canadian status.

What is wrong with continuing your life in your home country?

As your girlfriend only (no common-law) there is nothing you can do unless she comes on her merits. i.e International student, foreing worker or PR.

If you marry her then she would qualify as a family member.

In your current situation these are your smart options.

@Sharon - I would love to continue living in my home country but most of my family have moved to Canada as permanent residents and the current political and immigration situation in my home country is becoming more and more unstable. I do not wish to be separated from my family and girlfriend, should anything happens, and hence recently I´ve been trying to find a way for her to come over with me to Canada, and have been reading relevant articles on the CIC website but I am not sure which category my girlfriend would fall into if I were to sponsor her.

Sharon, do you mind expounding a little more on your statement "or CIC will look at the out of country common law situation and think the sponsorship is simply for her to gain Canadian status" - I don´t really understand this bit.

@DocD - We have been living together for 3 years. Is this considered cohabitation and therefore a common-law relationship? I´d really love to tie the knot with her but I´ll need a few years to work and save up for a decent wedding. If we were to register ourselves as married couples with the Marriage Licence Issuer at the Registry Agent Office (ie. legally we´re married on paper), but put off our wedding ceremony for later, would that still count?

you may have to throw your ´ideal solution´ out the window.

What you want to do may not be what works for CIC. Common Law status could mess with your PR status in Canada because you are showing no intention of establishing your life in Canada. Staying together may not work because they may refuse her a visa. For certain, bringing her to Canada as a spouse and then sponsoring her is dreamland.

The short and sweet option - marry her. Get a webcam and cheap long distance phone cards. Get your butt back to Canada and get working so you can begin a family class sponsorship application. Go see her for a couple of weeks in the middle of the applications.

Biggest challenge - proving your intent to follow through on your Canadian residency requirements.

Thanks Sharon for the advice. I really should´ve have came over to Canada earlier to work, I would´ve been able to sponsor her by now. I´d really love to have her come and live over here with me.

Sharon, would you suggest me to marry her in Canada or in my home country? Or should I marry her over in my home country, and then marry her again in Canada? I can´t believe I´m asking questions like this. This sounds so silly to me, but in the end as you say, what I want to do may not be what works for the CIC. I just want her to live with me and not be separated because of nitpicking immigration laws.

For what you said, it is very unlikely that she will get a visa to come to Canada to marry you. You can marry her in your home country, then you are going to have to come to Canada, stablish yourself, sponsor her and when approved then you bring her over.
