Subject: Asked to leave Canada immediately...
  Hello,

First of all Happy New Near to everybody!

My question is related to my brother-in-law´s situation.

My sister´s sponsorship application for her husband was refused in October. Her husband is American resident and has been in Canada, legally, for more than a year. He never broke any law! After the refusal of her sponsorship application, my brother-in-law applied to have his tourist visa extended. While waiting for an answer from Canada Immigration, he went back in US and entered Canada as a visitor in first days of November. No date of entry was stamped in his passport and he did not receive a pink paper (visa extension form I assume)... A few days ago, he received an answer from Immigration saying that his tourist visa was not extended and that he must leave Canada immediately. Since they have a new born baby, my sister and her husband plan to leave Canada in February (not immediately). My questions are:
1. What does immediately mean for Immigration?
2. Will there be a problem for them if they leave 45 days after being asked to leave Canada ? (only my brother-in-law was asked to leave, my sister is a PR, but she will give up on this status)
3. Is any chance that Immigration appears at his door and picks him? If yes, how soon can this happen? My sister and my brother-in-law have already bought tickets to fly to US, but are staying till Feb, because they a have a doctor appointment for their daughter...

Was their spousal application refused in Canada or abroad?

There are no exit visas in Canada so they won´t know when he left.

Thanks a lot Roy for your prompt response. Their spousal application was refused outside of Canada... Isn´t it normal for Immigration to know that my brother-in-law left Canada as he was asked?
