Subject: Residency Appeals
  To All

If your appealing a removal order due to your lack of residency there are two key issues the Immigration Appeal Division looks at.

1. Have you complied with your residency obligations?

2. Is there a logical reason to show you compassion?

You probably would not be at the Appeal stage if there was solid evidence that you had complied with your residency obligations of a PR.

Remeber when you submit documentary evidence always think twice how others would view this evidence.

Another Representative Case in Point.

Married couple with three children Immigrate to Canada.

Father/Husband creates Internet company and returns to home country claiming he is working for a Canadian company.

Wife/Mother and three kids remain in Canada.

Wife/Mother does not work.

Three Kids all attend school and there is evidence of same.

Father/Husband returns to Canada after considerable absence and applies for renewal of PR card. Investigation ensues and he submits evidence to be assessed regarding his company etc.

Father/Husband submits lots of evidence that his company is paying him a fee for services renderred.

Father/Husband submits CRA Notice of Assessment showing his only income is the Canadian Child Tax benefit for his thee kids (formerly Baby Bonus) There is no evidence that the Father/Husband is supporting the wife and the kids.

Residency Appeal is refused.

If one is avoiding paying Canadian Taxes while their depenents are enjoying free education and health care their is no reason to show compassion.

COMPASSION IS COMMON SENSE!

Not everyone will interpret your evidence as quality evidence so be careful what you submit.

Yup Vacation finally was looking for a life. Great place to visit but home is where my heart is.
