Subject: Spouse Sponsor advice
  Hi,
I am in USA and will be leaving for India in 4-5 months. My wife is a born citizen of Canada and we got married 4 months back in USA.I do have the marriage certificate by country office.
Now,I have a tight situation,I was on H1 visa now and I applied for my extension but unfortunately it seems like they will not extend my visa, so I have only 4-5 months to stay in USA.
My question is, is it feasible to apply for sponsorship in USA or in India.
I need to know the processing time for USA and processing time in India, if any one can tell me.
Also, I have one question that I had studied in Canada for more that 2yrs, will this stay counts to get my citizenship quicker( Question to be asked later)?

your wife can begin her sponsorship process now, on the assumption that she can prove she is returning to Canada. She will need to advise CIC that you will be going to India in 3-4 months because that will determine where the second phase of the application is processed. Processing time should be about the same.

your 2 years in Canada will not count to getting your citizenship quicker. you will need to be in Canada 3 years after you have been approved and landed as a Permanent Resident before you can apply for citizenship.

In-fact she is in Canada itself. Sharon, you being immigration expert can you tell me how long will be the whole process time. Also, one more things how to get Canada police Clearance as I was in Canada.. any idea how ?? and also how to get US police clearance?....

If they will not extend your US visa then you won´t have enough time to submit an application through Buffalo.

Processing times are about 1 month in Mississauga (for all outland applications). And then... Either approximately 4-8 months through Buffalo or approximately 2-5 months via New Delhi.

Different countries have different processing times...

Have you already submitted the spousal sponsorship via Buffalo?

Yes, I did last week. My wife send all the doc to missisauga office. They are saying that 3 months will take from your wife side and 3 months for my side.. Is it true??

She is going to apply today to missisaugga.. Here in USA FBI clearence are taking 4 mos from USA. Should I go to India and then get the clearence or apply in USA for it..

Apply for FBI clearance now. It takes the same amount of time no matter where you apply from.
