Subject: Family class sponsorship help
  Good Day Sir/ Maam!

I would like to ask a few tips about the sponsorship under Family Class.

My Aunt is a permanent resident and a Canadian citizen in Ontario Canada. She offered to sponsor me, but unfortunately she was denied for sponsorship. She advised me to continue on the application, and I was wondering if you could share some tips so as I may be granted this application and a visa.

I am her niece, and I will turn 22 years old in a month. I am single, and was never married. I am a Filipino and is in the Philippines.

Will I be granted points if I am fluent in French? For I do not speak French, I am only fluent in English both verbal and written.

Also, may I ask if I will also be granted points if I take the IELTS exam and include it in my application? Though it wasn´t actually required in the sponsorship kit requirements.

Do all of my documents need to be authenticated in the Department of Foreign Affairs (DFA), the one with the ´Red Ribbon´? It wasn´t exactly stated, though originals must be submitted.

I would greatly appreciate your help, Sir/Maam. I am at lost and is really looking for some help and advice.

Your aunt must have been denied her sponsorship because you are not an orphaned niece. Since you have parents still living, you cannot be adopted by your aunt.


Family sponsorship programs are Canada´s immigration program based on humanitarian tradition, which have nothing to do with points or language proficiency tests such as International English Language Test(IELTS).

There are other ways to immigrate to Canada.

She was denied, yes. But she was given to choice if she wants to proceed with the application. And she did. So she mailed me the kit to continue with the process.

What are my chances to be approved here?

Unfortunately there´s zero chance you will be approved under family class since your aunt does not qualify as a sponsor.

You should submit a new application through one of the other application streams (e.g. skilled worker).

if you want to come to Canada and you do not have a sponsor that qualifies, you must come on your own merits.

if your sponsor is declined, there is no appeal and no chance.

You should know that there are several restrictions that your sponsor has to respect. Don´t waste your time and money.

Who can be sponsored
--------------------

You can sponsor:

•parents
•grandparents
•brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, under 18 years of age and not married or in a common-law relationship
•another relative of any age or relationship but only under specific conditions (see Note below)
•accompanying relatives of the above (for example, spouse, partner and dependent children).

Note: you can sponsor one relative regardless of age or relationship only if you do not have a living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and you do not have any relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act.

Who cannot be sponsored

Other relatives, such as brothers and sisters over 18, or adult independent children cannot be sponsored. However, if they apply to immigrate under the Skilled Worker Class, they may get extra points for adaptability for having a relative in Canada.

I know that as a sponsor you can not seek financial assistance or income support for 3 years for you or your spouse when he/she has been sponsored by you as a permanent resident, but I am wondering if the sponsored person has the right to get into into government funded E.S.L.(English as a second language) classes or any other funded education program for new immmigrants in canada if they wish to. I am writing from Alberta-Canada

ESL classes are not financial assistance or income support.

as for your understanding about sponsor restrictions, when someone sponsors, they cannot be getting any government financial assistance. They need to have a job. They then sign an agreement with the government of Canada that they will be 100% responsible for looking after the needs of the sponsor applicant. IF the applicant requires financial assistance - the government will recover that money from the sponsor. This is even true if a couple has divorced.
