Subject: Inland Approved by Concept "Can you leave canada"?
  Good afternoon every one !
what a great forum that i found through Google,
I have a question to throw out there, I have overstayed in canada a while ago and The Canadian Border Services had me sign the paper where I can´t return to canada if i leave till 1 year ... I Can´t remember the letter name.. When my wife applied for an inland application for me , CBS stopped all their process and had me call once every month ( Voice recognition system ) Which i still do till this day.
My question is IF I GET approved by concept, CAN I Leave Canada and come back? I know that after getting approved by concept there´s a wait time to GET your PR but I have Extreme family matters back home that requires me to be in my home town....

Let´s assume that I did get approved by concept for a second, what would the next step be to be able to leave and come back ?
A) Work permit ?
B) Authority to return to Canada ?

Unfortunately it´s not good news. First stage approval does not come with the permission to leave Canada.

If you decide to leave Canada at any time during the processing of an inland application (including after first stage approval) - there is absolutely no guarantee that you will be allowed back into Canada. If you leave and cannot get back in, then your inland application will be classified as abandoned and canceled. If your application is canceled, you will have to start the entire process over again from scratch.

Since you overstayed previously there´s probably a good chance you will be questioned when you attempt to re-enter and a possibility that you won´t be allowed back in.

Why do you not withdraw the In Canada Spousal Application and submit outside of Canada Spousal Sponsorship.

That advice is based on the word "EXTREME" family matters.

Your removal currently is being deferred based on Public Policy because the In Canada Spousal Application was received prior to being called for the Pre Removal Risk Assessment. See Inland Processing Manuals IP8

Processing times are much faster outside of Canada and it takes seven - eight months to get Stage One Approval for In Canada Spousal Sponsorships.

It´s only 42 days for your Sponsor to be approved and normally 4-5 months from some visa posts or as little as 2 months from some Visa Posts. See http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp

Thank you all for your reply.
i called immigration and explained to them my situation and for some reason the LADY who read my case said i could leave if i had a work permit i think my show stopper in this case is the Canadian border services, if it was not for them i´d be able to leave.
