Subject: Can I apply for visitor visa if I lose PR status?
  Hi:
I´m wondering, lets say I do no satisfy the conditions of my PR status (ie: staying abroad for 4 years over a 5 year period) and lose it, can I still visit Canada using a visitor visa? I ask this because realistically I´ll be spending most of my years in another country other than Canada, and don´t mind losing my PR and just becoming a visitor again. I have friends in Canada I still wish to visit often, but do not envision myself actually living here any more. If I lose my PR, does that affect my ability to come back to Canada as a mere visitor?

Technically no. But you are going to have a hell of a time getting a visa.

Hi Jackie,

Yes. You can get canadian visitor visa even after losing the PR status, provided you are not in conflict with the conditions of IRPA as a permanent resident of canada. You can apply for multiple visa also.

Thanks. Can you clarify what you mean by:

If I´ve lost my PR, what sort of conditions of IRPA would I still be bound by?

DocD who is possibly a CBSA person is correct. When one deliberately fails to reside in Canada after obtaining permanent resident status they have that status taken away from them, hence no renewal of PR card.

Since Jackie is from a country that requires CVV´s she would have to apply for a CVV and the Visa Officer would have to consider if Jackie is using the system to return to Canada to fight to obtain her PR status back through the IAD and courts.

It is always easier to say no than to have your Boss told you made a bad decision.

So what´s the best thing for a Canadian PR resident who´s decided he/she cannot commit to all the requirements of the PR system, no longer wishes to become Canadian, and just want to still be able to visit Canada from time to time, do? Renounce his/her PR status? For me I´m considering taking up a job overseas that surely cannot afford me to still live in Canada 2 out of the 5 years.

Correct me if I´m wrong but the best is probably to surrender your PR Card to a visa agent BEFORE you fail to meet your PR obligations. Otherwise they will treat you as a criminal because they consider failure to comply with the law as some sort of criminal activity (Yes)...(Soooooo much easier for visa agents to bother you and me rather than look after the next millenium bomber eh)

A very simple answer to your reaction

I do know at least 5 (Five) persons, who have surrendered/lost their PR status and got multiple visa afterwards.

5 out of how many? THAT is the $64,000 question. Is it possible - most certainly. Is it likely? well... it is certainly a great way to park yourself inside the country and then try and H&C application which is exactly why CIC is inclined to say no.

is it better to surrender the pR on expiry ie in july 2012 or just let it pass, without surrendering , if it is not possible to stay in Canada
As I have an apt in canada, i will need to visit the place and will need a multiple entry visa.
In view of this , what is the best possible way .
