Subject: Residency obligation not met
  Hi,
I including my wife and daughter become PR in April 2007. Stayed in Canada only for one month then returned to my native country Bangladesh. Meantime we have a son born in Dhaka. I applied for visit visa for my son in local high commission office and refused consequently for justified reason for us (how can we move without our young son?) we did not move to Canada as the baby is too young and by the time we are outside Canada just more than 3 years.

1. What can we do the moment to retain our PR?
2. Is there anyway I can get visa for my child?
3. Can I get entry permission to Canada as still I have a valid PR card although already outside Canada more than 3 years?
4. If I get entry permission can I sponsor my son from Canada? How ling it usually take? I’m afraid if my wife’s and daughter’s PR expired till I got immigration visa for my son.
5. If all failed can I surrender my PR card and reapply from scratch?

1. Get on a plane and come back and fight for residency.

2. If your residing in Canada you can sponsor your child.

3. Buy a one way ticket and if you have problerms at the POE tell them you wish to appeal to the IAD.

4. Use H&C!

You will not be refused of entry at the POE, it is not up to the CBSA officer to revoke your status at the airport.
He/she might give you heck but that is as far as going to go.

The only thing that the officer will do is put some notes to inform CIC who will eventualy come after your PR status.

Two tips:
1- Don´t let your PR to expire, because then is going to be a pain in the rear end to obtain a temporary travel document to come back to Canada and the officer abroad MAY revoke your PR status.

2- Once you enter, then you can sponsor your child.

There are a few things that you are going to have to explain to CIC about the "why" you have been living outside of Canada this long.

3- Next time, make better plans if you need to leave the country for long periods of time.

He is not going to have to tell the CBSA officer about IAD, he is going to have to run that one by CIC when the time comes.

DocD - If you read the initial statement again you will realize that Monir became PR in April 2007 - He is not meeting the residency obligation anymore - Doesn´t he have to reply for his PR?

Hi,

We made our landing in 2007 with our 2 little kids and our PR card is valid until 2012. We were forced to stay back outside Canada because our little daughter started being prone to cold weather develops violent isnophilia and wheezing.

She is currently on medication and we want her to be cured completely, can we approach the authorities on humanitarian grounds.

Our plan God willing is come back to Canada for final stay before our PR card expires

Monir can return then sponsor his child but it will take a long time because his own status will be under review first. In the meantime, someone has to take care of the child overseas.
