Subject: Visitor Visa refusal
  Hello, Would appreciate very much if someone can advice.

My brother applied for visitor visa to Canada with an invitation from a Canadian company that he does business with. His visa application was refused citing his visit was not legitimate and that he will stay in Canada permanently. This is the second time he applied for visitor visa and got refused. The first time was in 2008 when I invited him and his visa application was refused citing that his ties in Canada and that he will stay permanently in Canada (regulation 179).

My brother does not have any intention to stay in Canada permanently! He has family in India and an established business that is operating successfully in India. He submitted sufficient documents to show his ties in India (company ownership, company registration, real estate ownership, company balance sheet, income tax returns, bank statement etc)> He submitted original invitation letter from the Canadian company along with sales invoice and purchase order transaction between his company in India and the Canadian company. He was suppose to travel to Canada to visit the Canadian company for sales meeting with the company President to to finalize the distribution rights in India and go through product training for their equipments to sell in India. He was also planning to visit me during his visit. I am extremely disappointed that his visa is refused. I am also worried to learn that my brother may never be able to visit me and that Canada discourage family members visiting. I am a Canadian Citizen and have been living in Canada for more than 13 years. My parents visited us last year and they did not have any problem.

Could someone advice what we could do? Is it worth to appeal the case? Seek an immigration attorney? I really would like my brother visit me in Canada. Thanks for your reply!!!

Hi!

I´m in a similar situation and I share your frustration. I´m a PR living in toronto and I invited my fiance who is chinese to visit me for 2 weeks here. Unfortunately, her application was rejected - reasonable feedback nor reason more than a standard line was not provided. I´m originally from western europe and I am not used to this kind of unfairness and act of caprise. I have a very good job here in toronto (not to mention that I pay much more in taxes than the average canadian) but I consider leaving canada.
In my opinon CIC is discriminating people from asian countries. I get the feeling that if my fiance and I decided to live in canada, her family might never be able to visit us.

From my understanding vistor visa applicants have no right to even file an appeal or any other legal means but re-apply (and pay the application fee again). Considering the cost and effort to put the application together, this is a big rip-off and canada should be ashamed of this practise (in our case the whole evaluation probably took less than 2 minutes - neiter an interview never took place or some kind of request for further information). I´d expect this kind of treatment from a banana republic not from an G8 country! maybe canada is not as civilized as it appears...

Discriminating? That makes two of us Brian.... and so many more. Some people are making money out of Visas and Immigration. Careful with them, they will sugarcoat everything. Bitter reality will kick in shortly after landing.

did either of you submit a letter of invitation? my friend had to try 3 times before they said yes. There are some sample letters of invitation on the CIC website.

Brian, you are dreaming if you think CIC will let your fiance into the country regardless of what country she is from. What guarantee does CIC have that she will go home. None. There are far more compelling reasons for her to ignore the expiry date on her visa and that is exactly what happens more often than not so... marry her, and sponsor her. Finished.

trust me, we did our homework. I´ve been working in financial services for public services that requires a high degree of accuracy. In addition, I went through the PR process myself and therefore have some experience with CIC.
we submitted a document containing about 25 pages including an absolute professional letter of invitation that states that all costs for travel, accomodation, insurances, etc would be covered by me. The file also included a detailed travel plan for each day (!), a letter of my employer (including contact person for further questions, salary, etc.), copy of my renter´s agreement, financial statements (including bank accounts), tax return, etc.
In addition, I included a letter that showed compelling reasons for her to go back to china after her trip to canada (she owns an apartment, she has a job, she has family (parents, siblings), our wedding is supposed to take place in china that her relatives can participate, furthermore we wouldn´t risk her PR visa by having her stayed illegally in canada after expiration of her vistor´s visa, etc.). again, for me this application and the supporting material was convincing to grant a visitor visa. my familiy in europe was more than surprised when i told them about the refusal.

What makes me very suspicious is that people have to apply several times in order to get a visa. what changed CIC´s mind that your friend got the visa after the third application?
To me it sounds a little bit like gambling and has nothing to do with a fair evaluation... again, this is banana republic style...

there is a small thing we don´t consider - risk. Unfortunately, to deter bribery of immmigration employees, a performance record is kept on how many applications go sideways from each agent. Perhaps the risk seemed to high.

the third time lucky was when I changed the invitation from I to we and made if very matter of fact - no emotional relationship indicated whatsoever.

btw: yes, I agree with your previous statement (marriage and sponsor her). I wanted her to see how I live before we get married. However, we will not apply for another visitor visa - this is wasted money...
isn´t that weired that CIC is kind of forcing couples into marriage before one partner has visited the other partner´s living environment?
in addition, i´m looking forward to some stupid questions from CIC when we go through her PR process a la ´how come she´s never visited you before you got married?´...

yup, they will probably ask the stupid question but you will have proof that you tried 3 times... now if that is not genuine love, nothing is. right????

CIC seems to be a rogue elephant out of control, whimsical and nefarious beyond every imaginable limits.

They even violate their own rules sometimes!(Jeeeez!!)

Gooood Lord...and we can´t even sue these guys with no names that´s the worse! I´d like to ask for zillions of dollars in damages and compensation! Or...maybe I should just throw away my PR card, pack up and leave eh...

I doubt that the rules are much different in other high-draw countries.

It is your choice if you want to throw away you PR card. I doubt that CIC will light their hair on fire in distress.
