Hi,
I have a friend in US.
I am giving his situation in his language below. He wants to come to Canada. How can he legaly immigrate to Canada.

" I came to USA in 1997, then I overstayed my visa. In around 1999 / 2000 I contacted a lawyer who I had heard would get sponsorship and get green card , so I pursued further, he got me sponsorship and Labor Certification. I got the sponsor through third party. Unluckily for me , the sponsor and the third party had some dispute among them. The sponsor backed out and I was left in lurch. Then the lawyer promised me he would get me another sponsor, couple years passed by, he filed some fictitious papers and got me WORK AUTHRISATION CARD by which I got my SOCIAL SECURITY CARD. I opened my first bank account in 2005 when I got the EAD Card. In the mean time I had paid couple of thousands of dollars. The lawyer said this case is temporary and I had to file another case, I was so desperate by this time. Anyway he got me another sponsor, filed again with different job description, 5 yrs passed by, my case was transferred from TEXAS PROCESSING CENTRE to NEW YORK. In the mean time my lawyer´s office was raided 2yrs back by IMMIGRATION AUTHORITIES and had possession of all the file. The reason being, people working in the lawyers office were swindling money from other people, basically they were filing fraud cases to immigration. My lawyer was also disbarred from practising law, he appointed another lawyer to my case, as far as I know this lawyer disappeared after the raid. Now I got a e-mail from USCIS regarding my case for I140, they have sent mail to my sponsor it was returned undeliverable, probably they changed the address.Both my I140 & I485 is DENIED by USCIS. Now my position is I have my WORK AUTHORISATION CARD valid till August 2010., after which I will be deemed illegal. I am so frustrated after spending 12 yrs of my life and spent achunk of my savings.My EMPLOYMENT AUTHORISATION CARD Expire by 28 AUGUST 2010. I don´t know what to do. So please if you can guide me, I will be highly grateful."

very confusing, only the experts like Roy can tell if in this kind of situation your friend is eligible for skilled worker class or not? His status in US is going to affect his eleigibility for immigration is the main question that your addressing...isn´t it? good luck and wait for the feedback from the experts.

This forum is for Canadian Immigration issues and this is an American problem. If your not in the Ministerial Instructions NOC 38 and were admitted to the US initiallly for one year no one here can assist you.

Hi Roy,
Thanks for your quick reply. If he falls within 38 categories, can he file papers under Skilled worker category.
As of now he is in US legaly and he can have Buffalo as his visa office.
Does his status in US gets locked on the day his application is accepted at Sydney, NS.
what happens if his status changes subsequently. Does it effects subsequent processing of his application.
