Subject: How long do i still need to wait?
  Hello there,

My husband came to Canada in 2007 May as a visitor . We met in June 2007 and fell in love. In the end of 2007 we knew that we wanted to be together so we decided to live together. In the mean time his visa was expiring, therefore we applied for an extension for him. Which was refused because my hubby accidently didn´t add his passport copy. While his extension application was on process we decided to get married. In 2008 april we got married. In the mean time my husband lost his status. Due to financial challenges we couldn´t apply for his immigration right away. We needed to gather all the papers from his country (Netherlands). In 2009 april my hubby´s application was accepted. In September 2009 they transferred his application to the vancouver local admission office. We went to our local MLA and they told us 2 weeks ago that my file has not been assigned to any officer yet. It has become really tough on us financially and emotionally because it´s only me who can work. My husband is getting frustrated not being able to do anything. Can anyone tell us what the timeframe would be for my husband to become an immigrant? Thanks for your time....

your MLA has zero clout with Canada immigration - zero.

Again, we are facing an inland application with an applicant that is in trouble with their status.

You could be waiting another year.

what are you options? To start again at this stage is not going to save you any time. The only concern I have is the lack of appeal opportunities.

From what you are saying, you have been approved as a sponsor - right? The file went to phase 2 about 6 months ago. have a look at this:
http://www.cic.gc.ca/english/information/times/canada/process-in.asp#sponsorship

Yes, it is hard... but you are together. Can you imagine families that are living apart and paying bills in 2 locations. Family class sponsorship is not easy - for anyone.

hang in there.

oh my. Where is Roy when I need him?

I am going to suggest we all hang tight until Roy chimes in, but if you have a job, have not claimed bankruptcy, have not sponsored someone before... I may be inclined to withdraw the application and start again as Outland and this time, get some assistance.

Regardless, even with an outland application you will be looking at 8 months to a year before hubby would be landed an eligible to work.

again, we need Roy. If he leaves voluntarily, I think the situation could be more favourable.

Don´t lay in bed crying all night - it is not going to help you. Hang tight another day or so and let´s see if we can´t get some of our regulation types to spell it out clearly. I don´t want to point you in the wrong direction and I don´t want to add any unnecessary distress - especially if I am wrong.

what we are going to need is answers to the following

1- have you ever sponsored before?
2- ever been on welfare or claimed bankruptcy
3- hubby have any criminal convictions?
4- your dates are a little confusing - when did you send your file to Viegreville? Any correspondence from CIC - if so, what did it say.

Imagine an Immigration Officer looking at some guy who is sitting at home watching Oprah all day long instead of getting out there to put food on the table so he can afford to buy some Lingerie for his Lady.

There is suppose to be 46 thousand undocumented workers in the GTA and some 600,000 illegals in the country. I wonder how many are working without authorization to be able to eat?

I can not tell anyone to work illegally but I would respect them more if I was an Immigration Officer than the healthy young guy begging at my exit from the 401 everyday.

OK Roy, he should risk working... but what else (if anything) can you suggest they do at this juncture without making matters worse?

Work, take the risk, and wait it out?
