Subject: US to Canada Help
  Hi there,
I´m engaged to an American and we´re having a tough time making heads or tails of all the information that´s being thrown at us from websites and from other people.

A lot of people are saying that it´s going to be close to impossible for us to obtain a way for him to be here with me for good...or that it´s going to take forever and cost us a fortune.

We don´t know what steps to take, and we have no idea what to do. Can anyone just break it down in plain and simple english for us about the best route to take?

Thanks!

forever is a relative term.

are there any criminal records to contend with?

married or common law for a year is the only thing CIC considers. So, for the time being, one of you has to do some ´visiting´ without options to work and permanent residence being maintained back home.

Once you sort out the marriage /common law issue - the next critical decision is whether to apply INLAND or OUTLAND. DO NOT be tempted to apply inland. It takes forever, and there is no option for appeal if something goes sideways. Even if honey is sleeping beside you every night - apply Outland. It relies on the premise that he is living elsewhere until immigration is approved. That does not mean he can´t be with you for a visit.

That said - crossing the border with an Family Class sponsorship in the works is a challenge. So, timing is everything.

Outland is the ONLY way to go and married is the best way to get things happening fast. By fast I mean 8 months to a year - start to finish.

Keep records of everything. A marriage certificate is not enough for CIC. You have to make the case that your relationship is genuine and not for the purposes of immigration. Do lots of research.

Thank you for the quick reply.

We have been keeping a journal with cards, photos, ticket stubs etc.
I´ve also decided to contact my phone company and have them send me the phone records with my calls to him - since I don´t pay long distance.

I´ve been hearing conflicting things about sponsorship and his being able to work. It doesn´t make a lot of sense to me. If we get married, and he´s still living in the US - do I have to sponsor him still? What do they look at in the sponsorship?

if you want to live together - one of you is going to have to sponsor the other! If there is an Canadian inland application, there is a option to work once the application reaches a certain stage but do not be tempted - it takes FOREVER and if something goes sideways, there is no option for appeal.
