Subject: Being led to a disaster
  Yesterday I met a lovely couple who have been led to the brink of a disaster. They also seemed to have followed along willingly. Why?

Only (now) they are researching everything and have found this site. Then came to see me yesterday.


The Story protecting privacy!

They retained Counsel (A) who recommended one application even though it did not seem logical & he went along. That failed.

Then Counsel (A) suggested another application and they went along like Lambs to the slaughter. Only when it came time for an interview did they lay their cards on the table and tell the truth. Immigration Officer recommended the correct course of action.

So they retained Counsel (B) to do an inland marriage application as common law because they were not legally married. They have three Canadian children. They claim they paid counsel (B) and counsel (B) submitted the application without the sponsors status document and the required medical form. It sat in limbo!

Sometime in this process there was a PRRA and since the application was not complete CIC and CBSA will not defer his removal. On Thursday he will board a plane and leave his partner and his (three kids) behind.

WHAT SHOULD HE DO?

I suggested get married immediately.
Withdraw the In Land Spousal Application because the sponsor can not have two spousal applications at the same time.
Submit an outside of Canada Spousal Application and include an ARC letter.

Well he talked to someone else Counsel (C) who said CIC will question his marriage as non-genuine because he got married a couple of days before he was deported.

He claims he took bad advice from Counsel (A)!
He claims he took bad advice from Counsel (B)!
I think Counsel (C) is giving him bad advice about not getting married to his long time partner just before leaving. Don´t forget they have three kids.

WHAT DO YOU GUYS THINK?

Should he get married just before he gets on the plane and explain that they will have a huge reception this summer in his home country because of the expense. He is paying for his own removal. Do you think it is best if you have an unusual situation it is best to explain it by telling the truth and giving logical reasons.

Or do you think they should wait half a year with three little kids before everyone can go to his home country and have a big wedding? Then wait another eight months to be allowed to return?

Their kids they will get over missing their Daddy! I just can not see waiting and then trying to get those three kids on a plane back to Canada while their grabbing onto Daddy so he comes with them or they don´t leave him again.

Another logical thing CBSA is doing!

my 2 cents worth...

if he is out of the country, then the common-law status starts to fall apart - right? I say, get married, (they have absolutely nothing to lose by doing so) together with the outland application.

I hope Mary is reading this. She is of the opinion that only bad things happen to her. I doubt that these folks have criminal convictions to deal with and even then... look what CIC is doing to them. Sometimes the long way is the only way.
