Subject: desperate
  I am an american citizen, my husband was barred from the US for 10 years. When returning to Mexico he found himself in a situation that cause him to flee to Canada as a refugee claimant. It was denied, as they are denying everyone from Mexico. We appealed to the federal court and they rejected it, he entered into the PRRA process and we just received notice that he has an appointment for thier decision on Dec 15th. I am fully aware that only 3% of PRRA applicants are accepted and I need to know what to do next. We have spent thousands of dollars US and Canadian to try to find a country where our children can live safely. If you have seen any news on Mexico you understand that is not possible there. My children do not speak spanish, they are US citizens my oldest is from a different father, 16 and cannot get the education she needs if sent to mexico as she speaks no spanish. Two of my children have been attending school here in Canada under my husbands work permit but my status is visitor. I tried to gain employment and they rejected the LMO. Please help! My children need thier father as do I and we can not live in Mexico!!! What do I do??

My husband is also from Mexico, he also has been barred for 10 years from entering the States. I too have actually three children from a previous marriage that don´t speak spanish. I also have two younger children with my current love of my life. We mananged to work around the LMO, and get a work permit under the Nafta Treaty. You don´t need a LMO if your profession can lie under one of those professions. He was able to fly to Canada as a visitor and then we applied for his open work permit after he got here. All the Immigration officers told me that he could NOT apply for work permit once inside canada but they are wrong. Most of them really don´t know the laws of Canadian immigration. I obtained my work permit under Industrial Design thru the Nafta treaty and moved to Saskatchewan first, then i brought him here. Now we are going thru the process of PR. I have been told by many people that we should NOT be denied only because of his unlawful presence in the STates. (He has no criminal record though). So far so good, we´ve been here for a little over a year.

do you know if you have to have a college education to qualify for the nafta treaty??

I only have a diploma from a tech school. So, I´d say yes, at least a diploma, and minimum 1 year work experience. Basically the same requirements to get a work permit, but without the need for the LMO.
