Subject: Landing process
  Hi

My husband, 4 children and I are going out to land in Canada next week (we have our visas, confirmation of PR) but are just staying for 2 weeks and then coming back for the children to finish this school year i.e. moving out permanently next July. Bearing in mind that this time we are not taking anything (just holiday stuff) but next summer we are shipping everything can anyone tell me how long the process is likely to take at the airport and do we have to declare ´goods to follow´ with an itinerary? We have not packed anything yet and were not planning on telling the boys about the planned permanent move until a few days into this ´holiday´. I don´t want to be caught out if I need an itinerary of all our belongings this time not find we are at the airport for hours with the childrne wondering why.

Any help and advice welcome.

Yes, you need your goods to follow list when you land or you will be taxed on everything you bring in when you permanently move next year. It must be a complete list of all your household goods, vehicles, etc, and include the value in Canadian dollars of each item and any necessary serial numbers (for items such as laptops, computers, cameras etc). For smaller items, you may combine like items such as kitchen utensils or clothing (your list will then declare something like this on one line: 8 boxes children´s clothing: value: $X. Make certain that your list is very complete and if you are bringing your vehicles make certain to check out www.riv.ca for current information and allowed vehicles.

You should call and ask first prior to landing.

Usually if someone is going to "land" they ask that you not be leaving the country for atleast two months.

You also must have a permanent address in Canada so they can send you your permanent resident card.

If you will be flying back into Canada and you are from a country that is not Visa exempt you could have problems with the airlines (without your PR card) as your visa would have been cancelled out.

The officer may suggest that you land at the time you are actually moving to Canada.

As well if you do wait until you are moving to Canada, you will have more time to fulfill your residency obligations (730 days out of each 5 years must be spent inside Canada)

My understanding is that you must land the first time you cross into Canada with your visa. Immigration officers don´t always like it if you are planning to go home after landing, but if your intent is to wrap up your lives (finish the school year, give notice at work, sell your house) a reasonable IO will understand. Be honest about your intentions and be prepared with all your paperwork. Those are the best things you can do to state your case.

JP is correct that you must provide a Canadian address for your PR card. Because it is not your address, the IO may give you a PR card application form to complete when you make your final move next year. It is totally fine if that happens; you will still have your canceled visa in your passport and a stamp proving that you are a landed immigrant. However, as JP mentioned, it might make getting back into the country more complicated depending on your situation. I think there is a one time only visa that you can apply for should you not have your PR card by July.

My wife was the Principal applicant when we applied for immigration to Canada in 2003. Immediately after the Visa was issued to us, my insisted that she want to go alone without me. And she did. Uptill now she has not called me to even tell me where she is in Canada.
My question is: Do I have the right to land and live in Canada as an abandoned husband or her "dependant" who currently has no trace of her where about in Canada?
I have enough fund to live and continue with my live in Canada.
Secondly, My immigration Visa will expire by January 2010. Is it possible to land and then come back to my present country of residence - Germany, hoping to finally move to Canada by 2011? Please help. Its urgent.

tough one.

if you are questioned at the airport, they will ask you where you are going. To say you are joining your wife as the principle applicant is a lie. To say you are landing on your own (which is the truth) will likely cause you to be sent home.

Your wife is under no obligation to support you in a skilled worker application. I would see if there is a way to track her down through family and friends to see what the story is. Perhaps the marriage is over and you are the last to know.

I am sure Roy would know the rules in this instance better than I do.

My husband is sponsoring me, I married and have a baby in Mexico with my Canadian boyfriend, My application for permanent residence is in process, In 2008 my Refugee Claim was denied and I left Canada voluntarily before the 30 days,I didenīt appeal, and I bought the plan tickets and I did back to my country, In the airport I got the Certificate of Departure, And now I did sent to Immigration a photocopy of the certificate of departure.
Now after 4 years Iīm applyng for the permanent resident.

I left Canada in 2008 before the departure order come in to effect, before the 30 days.

My doubt is the next: when I will land in Canada in the airport if the officer ask me if I been under a removal? which one will be my answer? yes or no
And I will have to answer the follow question for The Permanent Resident Card: Have you ever been issued a removal order in Canada?

I have to answer "yes" or "no"

In the application for citizenship in the future when I apply the question in the form is almost the same if I been under a removal.

please help me for answer right this questions in the airport when I will do my Land in Canada and for the PR Card application.

I donīt kno if I leave voluntarily means to be under a removal?
