Subject: NEED URGENT HELP! suspect CBSA officer unfair?
  My husband was on the removal list since Jan, 2009 and has been reporting to CBSA every Friday since Oct,2008(got bailed out, no criminal record).

About two months ago, the officer who interviewed him was changed from a lady to a white guy.

1. the guy tried to trick my husband into getting an "emergency document" from Chinese consulate. He assured that my husband will be safe and can definitely come back to Canada later on.
WRONG! We got the info from Chinese consulate that if you get this thing, Chinese government will know if you applied refugee before, and once you´re in china, no way you can return to Canada!

My husband informed him about this, and he still doesn´t care and want my husband to get it from a lady named " Xia Li" in Chinese consulate, according to him, he "arranged" an appointment with her.

My husband went and asked Xia Li and got the same result.

This officer started to pretend that he didn´t know the danger of it.

2. During the interview with this guy, he keeps mentioning that " I´m expert at sending ppl back to their country and ESCPECIALLY CHINESE". No matter how my husband was trying to coop with CBSA, he always sneer and thinks my husband "is playing game".

3. We didn´t trust him, so we didn´t tell him that my husband has got the new passport recently. He then emailed the Chinese consulate to "Xia Li" and got the info that my husband got the new passport.

He immediately arranged interview this Friday( yep, just two days ago) , and arrested my husband for the reason of " not co-op with CBSA".

During the interview, he asked my husband some questions as below: HE KNEW THAT WE HAVE A SPOUSAL SPONSORSHIP APPLICATION.

Q: Do you have any cash by you?
A: not a lot.
Q: Then are you working?
A: I have been home since the day I got bailed out.
Q: How do you support your life then?
A: My wife supports me.
Q: Did you borrow any money from some guy in china?
A: WHAT???????????

4. He and another officer gave my husband a paper (authorization to have CBSA inform Chinese consulate about his being holded), fill "yes" on the option and order my husband to sign without any proper explaination.
My husand knew that he can say "no" to this, so he asked them several times if he can say no, the officer unwillingly re-selected "no".

5. He then took away my husband´s coat and shoes to "CHECK" and left my husband in a cold room for nearly 2 hrs. My husand had cold with high fever about 2-3 weeks ago and just recovered from serious coughing.
My husband asked if the check is done, can he had his coat back, this officer neglected him and went away.



I burst out crying when hearing what happened this Friday after my husband phoned me at the detention centre.
I wonder if what this officer did is actually legal and I had contacted my MP office and manage to get an appointment next Monday afternoon.

Does anyone have any idea what my MP office can help me with the situation like this?

I already submitted the spousal sponsorship application, but it now has been transferred to local office, I have a clear idea that it´s going to be more than 2 years waiting time. However, it´s not the waiting time that bugs me.

I´ve been with my husband for years( 7 years before actual wedding day), married at the end of last year. He has been a huge part of my life, even though I have no problem supporting ourselves, and sometimes we fight over meaningless things( just like any other couples), i depend on him emotionally.

I was advised to contact MP for help, I will explain everything to the office about my applicationn and my husband´s situation, but my doubt is

What can my MP office help me with the situation now? Accelerating application process/asking to release my husband and has him legally stay until DM?

i´m confused at what they might help me with....

´from a lady to a white guż´??? what does that have to do with anything... or is it easier to assume this is all about race rather than criminal activity.

don´t count on your MP to do anything - they have no authority with CIC. Talk to them but you would be better off looking for a lawyer with extensive immigration experience. Sounds like they have some suspicions about illegal activity or there is someone with the same name out there who they have serious concerns about.

There is nothing the MP can do to stop your husband from being removed. You want to try to stall deportation, you need a lawyer to appeal to federal court.

Sharon, about the "suspicious" thing, you mean my husband or the officer? Apparently, my husband has no criminal thing at all, and i need to mention this, ever since he got bailed out last time, he´s staying at home until now!

I do have a lawyer and a counsellor, problem is to one who can contact the lawyer directly is not me but the counsellor, and the suggestion they gave me? Ask my husband to wait back in china.

I´ve been in Canada for 8 years, and for such a long time, I´ve never felt racism until this guy. It´s nothing about the skin color he has, I´m just trying to describe, maybe someone else might met the same officer before, even though I have his name, I know that it´s private thing and shouldn´t be exposed.

If you think this is about criminal activity rather than race, what do you think about when he said he was especially good at sending back Chinese?
