| Subject: Spousal sponsor after outstaying visa |

I am a UK citizen. I Spent some time studying in Canada where I met my fiancee. I returned to to the UK and then returned to Canada where I outstayed my visa, due to financial reasons.
I have since returned to the UK but my fiancee and I would like to ge married and live in Canada.
If we were to get married in the UK, could she return to Canada and apply for a spousal visa successfully? Or would we be automatically turned down due to my previous overstay?
Please Note: I did not work or study illegally in Canada. I have no criminal record or any other black marks against me.

I don´t think you will face problems in the sponsorship process just because your overstaying. However, from your short message it isn´t clear if you were caught and deported back to UK. If you simply overstayed and went back silently to UK, there is no record or anyway that CIC would know this issue.

I was not deported but CIC were definitely aware that I had outstayed my visa. I did not inform CIC when I left Canada. I just hopped a plane to London and left

hmmmm...I am from UK. Have been in similar situation but CIC were not aware. I still think it can be ok but it depends on what you mean by :"but CIC were definitely aware that I had outstayed my visa." How did CIC become aware? why? CIC usually gets involved if you did something wrong during your expired visa..such as: arrest, trafiic accident etc etc

CIC were aware of my overstay because a friend who was visiting Canada (not to see me) from the US had mentioned me as a contact when they were interviewed by customs because she didn´t have her passport. This was on the same day they changed the rules for US visitors.
CIC called me and said my visa was expired and I should leave or risk arrest. I told them I was trying to leave, which was true. I had to sell the apartment I was living in before I could leave. I did this shortly afterwards and then left Canada.
