Subject: H&C - Parents
  Hello All

I am a canadian citizen and well established. My parents have a canadian visit visa and plan to visit me soon. They are old and alone back home, no one is over there to take care of them.

Does this substantiate the grounds for inland H&C application? I will also attach the sponsorship papers to H&C app; will it help in any way?

YES

You have to prove an Unusual and Undeserved Hardship which is the processing times for parents. PLUS......

Google sponsor your parents or look up on the www.cic.gc.ca web site and see how long it takes Mississauga CPC to approve a Canadian who meets the Low Income Cut Off based on their family size.

Thanks for your response Roy. I checked and sponsorship applications take an aweful long time.

Will it be better to just apply on H&C grounds and keep sponsorship out of it to reduce processing times? However the processing might be quicker but that could also weaken the application. What do you think?

it would be better to acknowledge the fact that your situation is not unique and that H&C will not likely be awarded in your situation. Getting in the same line as every other applicant is likely the only option you have.

The only arguement that can be made with an H&C (if you read Roy´s post carefully) is that the regular wait is too long - not sure how successful it is but the one you are proposing is not going to fly.

A flip side to your H & C application, or you sponsoring your parents under H & C inland ... you won´t get your answer in years but their visitor visa will not be renewed based on "intent to stay" then they will be in a limbo, no status, facing removal because a H & C application does not stall removal from Canada.

Thanks all for your time; it´s really appreciated.
I didn´t know that you could face removal if your H&C app is in process. Is this true for all H&C cases or are there exceptions? I assume sooner or later all H&C applicatns become illegal (no status) in Canada while waiting for a response.

Assuming what I´ve been told is true, it is not the case. You are only prone to being remove if you are a person without a legal status like overstay when you apply H&C. In any other cases, such as having a visitor status when you file your application, CIC will extend your visa until final decision is made.

I don´t think it´s absolute that CIC will extend a temporary resident status until a decision is made. My girlfriend got her 63-year old dad´s TRV extended for 6 months twice for a total of one year then no more, even though the officer knew there a PR application was in the system.
