My morning rant.

Some people (in Canada) have been waiting for years for Immigration to render a decision on an application. The wait and stress they are put through regarding the lack of action by CIC local offices is clearly not the objective of the immigration act section 3 (3) (f) which states prompt processing.

So how long is too long?

The answer is ______________!

It depends but if it is excessive, several factors have to be weighed. The first is how to complain and is my wait in my case unusual and undeserved?

Sometimes it is better NOT to complain and just wait!

There are several Lawyers and Consultants who write articles for various newspapers and some actually pay to get their articles printed in the media. SO BEWARE OF THEIR ADVICE! Beware of anybodies advice.

When an authorized representative recommends a certain course of action anyone thinking of retaining that counsel should always ask themselves why did he/she recommend that course of action.

Recently according to my client a Law Society of Up[per Canada member Mario Bellissimo supposedly answered a question in a free newspaper called 24 hrs regarding what to do regarding waiting too long. I can´t find the article so I say supposedly.

A person wrote the paper and said they have provided all the documents CIC has requested and CIC has requested updates two or three times and still they have not rendered a decision!

"What can I do"?

Apparently Mario Ballissimo recommended suing CIC. SUING CIC!!!!

To be fair to Mario suing CIC is one option that could get results. What Mr. Bellissimo was referring to was filing a Writ of Mandamus with the Federal court to force CIC to render a decision.

So lets get to the crutch of the issue.

Some person has submitted an Humanitarian and Compassionate application and five years have elapsed since it was transferred to the local office. Getting the local office to respond can sometimes be difficult and time consuming.

Time is money!

How much money can any Lawyer or Consultant charge for writing a letter or fax to the local CIC office???????????

How many faxes would they have to send to get a proper response instead of your client file is in queue and will be looked at when it reaches the front of the line.

Now Mario Bellissimo is a Lawyer and how much money can he charge for filing a Writ of Mandamus with the Federal court that won´t even be looked at for at least another year??????? $5,000.00 average but the Law Society of Upper Canada sets no rules on how much their members can charge.

In any H&C application it is the quality of the submissions based on IP5 section 6.7 as to if there are valid grounds to show compassion. Focus on the substance instead of switching Counsels because the new Counsel has a better way of taking some of your hard earned money.

Now I can not submit in Federal Court but if I was a Lawyer like Mario I would join a Consultants group to suggest this type of application for their clients so I could make more money.....whoops did I say something already done. Well that is good business I guess.

I use the media and sometimes it works others use the Federal court and sometimes it works. Others just sit and wait and sometimes that works.

What to do depends on your personal circumstances.

Sometimes it is better NOT to complain and just wait!

Dear Friends,
If the PR application`s inexplicably taking long time (longer than stipulated or expected)after submitting all the required documents, what does one do? Some say it`s better to just wait & not to enquire from CHC( Is it going to annoy them or something)?
If one MUST have to know the expected time for a decision what`s the best thing to do?
Any comments?

CIC is careful to qualify wait times. they always post them as historic and still qualify further. CIC hurries for nobody.

If you must have an answer, the only thing you can do is assume the answer will be no.

Hi all,

I have been applying for PR for more than 51 months. Recently, CIC has required for additional information and documents for about 5 months. Is that my case in progress or how long will i need to wait. Should i write to visa office. The frame time to finalize is about 54 months that i found in the www.cic.gc.ca. Anyway, i have not heard from CIC. I really hope that my case will be finalized as soon.

Dear Roy, thanks for your post... I actually have been away from the site for a while and just came to post a question ´How Long is too long?´... but I read your post and found it really interesting...

I´ve been waiting ages for an answer... got a lot of suggestions from people like you and Sharon on how to go about approaching CIC... but I just decide to forget about it... I dont even bother to email them anymore... but even doing that bothers me a little... I feel I should have gotten an answer long ago or at least a clear picture of where my application stands... but no, that is not what I get from CIC emails... their answer is always... sorry, we are still waiting for background checks...

It´s been almost two year (this December) since we had our Medical exams done... they are expired now... We have waited 4 YEAR so far... It is really frustrating...

I have been in Canada for 14 Years and and 3 Month , ..... and Still Haven´t become Landed Immigrant, or a PR.
i have Came to canada in 2006 and I was accepted under HNC in 2004 and i have been Cleared from security Checks,.... its been so Difficult for me to Contact with CIC or to explain for me a simple WHY THEY DOING THIS TO ME. They always ignore me and not answer my letters when i send them to simple why?
talking about Frustration?.....i am sick and tired of being Frustrated, i don´t sleep at night sometimes, just to Simple answer from to CIC to why they Holding my file for this long?
I haven´t seen My Mother or any family Member for 14 years and 3 month and 2 Days as of today.

Ps: i never left Canada, i have been a good Citizen and never done anything wrong, always worked and payed Taxes, and recently married to my Girlfriend of Five Years.

So your married, did you inform them of your change in marital status?

Maybe instead of posting after a August 2009 post you start a new post or retain Counsel to ascertain if they can get you a Christmas present!

Inprocess takes how long to finally show the outcome (in reply to: Waiting too long, Immigration.)
I have applied for a Canadian PR again after rejection earler when I failed to submit the documents. But this time I have taken every precaution not to leave any stone unturned.
Recently I checked my status as Inprocess on cic.gc.ca But how long will it take for them to take a decision to give me a medical call?
