Subject: trv regulation 179
  HI,

I APPLIED FOR CANADIAN WORKING VISA, I COMPLETED MY PAPERS BUT THEY REJECTED FOR THE REGULATION 179.WHAT SUPPORTING DOCUMENTS I NEED TO SUBMIT IF I WILL TRY FOR THE 2ND TIME?I TRAVELED IN QATAR FOR TWO YRS. AND THEY REQUIRED ME FOR POLICE CLEARANCE,I SUBMITTED ONLY MY PASSPORT AND LETTER STATING THAT I GONE FINAL EXIT WITHOUT ANY VIOLATION FROM QATAR GOVERNMENT,IS THIS ONE REASON THEY REJECTED MY APPLICATION?IS THIS IN CONNECTION WITH REGULATION 179?PLS. ADVISE ME...

This is Regulation 179 that you were referring to but what chapter did you not comply with, a or b or c etc.

179. An officer shall issue a temporary resident visa to a foreign national if, following an examination, it is established that the foreign national

(a) has applied in accordance with these Regulations for a temporary resident visa as a member of the visitor, worker or student class;

(b) will leave Canada by the end of the period authorized for their stay under Division 2;

(c) holds a passport or other document that they may use to enter the country that issued it or another country;

(d) meets the requirements applicable to that class;

(e) is not inadmissible; and

(f) meets the requirements of section 30.

THIS IS THE CONTENT OF THE RESULT OF MY APPLICATION;

YOU HAVE NOT SATISFIED ME THAT YOU MEET THE REQUIREMENTS OF REGULATION 179; THAT YOU WOULD LEAVE CANADA AT THE END OF THE TEMPORARY PERIOD IF YOU WERE AUTHORIZED TO ENTER.IN REACHING THIS DECISION I CONSIDERED YOUR TIES TO YOUR COUNTRY OF RESIDENCE/CITIZENSHIP BALANCED AGAINST FACTORS WHICH MIGHT MOTIVATE YOU TO STAY IN CANADA.PLS. ADVISE..

proof you own property, proof you have a job and are on holidays, proof you have stronger family ties at home than in Canada, and proof you have motivation to return home.

Dear Roy,

1st,regarding proof of property, i don;t have property yet in our country,I´m still leaving with my parents but I have my Bank Account.2nd, proof I have a job- I am presently working here in Saudi Arabia as an Electrical Engineer, 3rd, proof you have stronger family ties at home than Canada-I´m leaving with my parents since birth, i have residence certificate, Baptismal certificate,Barangay clearance,Police clearance and community tax certificate. and 4th, proof you have motivation to return home- I need to return home of course, my parents are there,and I have my Bank Account there, and I´m planning to buy house and lot soon.Pls. advise me Roy, if the above will satisfy them, I need to re-submit my papers before my L.M.O expires, this coming jan. 11, 2010.

The officer has a lot of discretion ... and given you have been unsuccessful once, you need to have more substantial proofs before you re-apply. You need to supply proofs to state your TEMPORARY INTENT - and having parents back home or even a bank account is not enough. Have you worked in other countries similar to Canada, and went home? Travel history ... have you visited other countries similar to Canada and went home? Is the job offered to you similar to your experience and education? What about the pay ... and other factors. If you have friends in Canada or your potential employer that you trust, he / she can probably apply for CAIPS notes for you. You need to sign an authorization to allow them to obtain the information for you. You will get the information on your application, such as visa officers´ notes, missing documentation or other problems that you may not be aware of. These information may be helpful if you re-apply. Dear Roy,

1. Proofs to state Temporary Intent- I will prepare this one..
2. Travel History- I worked in Qatar for 2 yrs., I have Police clearance,old passport stamp with exit,return ticket from Qatar to our country.
3. My Job offer is Customer Service Clerk, they offer me more than my salary here in Saudi Arabia.
4. My Girlfriend is in Canada, she´s already landed Immigrant, she can help me regarding CAIPS notes.

Did you tell visa officer that you have a girlfriend in Canada? If yes, and your job being a Customer Service Clerk (essentially a Sales Clerk) may have already raised doubts about your intention in Canada. Good luck proving your intent.

sir/madam,

i am from the philippines my husband is a canadian i want to apply for tourist visa coz i just want to visit my husband i really miss him so

much we are just newlywed, and we are planning to have our second honeymoon in canada and visit my husband

parents and realatives, and guaranty that i will leave canada on the end of my stay, wat i am worrying is i dont have

a bank accout or any finances, and dont have a job, my husband supporting me with all my needs, is it possible

that i can still apply for tourist visa, and my husband will cover all my expenses on my stay in canada thanks! hope

you can help me..

REJECTED DUE TO REGULATION 179 (in reply to: trv regulation 179)
my application for a tourist visa was denied. i´m a resident of abu dhabi for 10 months and i have a job. i submitted a letter from my company indicating my scheduled leaves, salary certificate, bank statement and an invitation letter from a friend. i just want to spend my scheduled holiday in canada and to celebrate my bday there with my close friend. i really dont understand the reason for the rejection of my application :(
