Subject: Conjugal partner visa
  hi! my boyfriend has just arrived in canada after his petition (residency) was approved.. he´s already considered as an immigrant for like 2 weeks now.. i would like to know if he can already process a sponsoship for me? what visa can i apply? we are not living together here in the philipines because both of us are bread-winners, and are still living w/ our families, but we´ve been a couple already for almost 7 years now.. we did not get married here, because we thought that it will affect his petition status..

please hit me back if you can give me accurate information what we can do..

Your case, the best course of action is to get married and then apply for sponsorship. You do not qualify for common-law as you are not living together and conjugal route also as you could have easily lived together or got married.

hi! this is roma again.. i have 2 questions regarding getting married..

do we have to get married here in the philippines? does he need to render at least 1 year in canada before coming back here and get married, or can it be sooner?

or, can i get a tourist visa, we´ll get married in canada, i´ll go back here in the philippines, and process spouse sponsorship, or can i stay in canada while applying for permanent residency?

You can get married anywhere. You should prepare everything which is required for spousal sponsorship, get married and the next day file for sponsorship.

1. If you are with your husband in Canada, you can file for inland sponsorship. The process takes about 12-18 months with no option of appeal. First stage approval takes about 5-6 months, after which you can get an open work permit.

2. The recommended way is to file for outland spousal sponsorship. For Philippines, the current processing times are about 5-9 months. You may be separated for a while as you can only stay in Canada for 6 months. However, you can try extending your visitor visa at the end of 6 months. There is no guarantee that it will be extended but you´ll be under implied status until a decision is made. For example, if CPC receives the application for extension on the day your visitor visa expires, from that day onwards till the day CPC makes a decision on your application you can stay in Canada (current processing times for extension of visitor status are 102 days).
