Subject: re-entry int live-in caregiver program
  does anyone has the same situation as me? please help.
ok i was not able to finish my 2 years live-in care within 3 years upon arriving in canada.so i phoned cic as to what am i gonna do and they said i can re-enter into the program but i have to apply outside canada like in bufallo NY.so i search cic bufallo to get in formation and actually i sent an email to them told them about my situation and the reply was to to go to their website so i went.i found how to apply for a wrk permit and etc.but i couldn1t find my specific situation.the only thing i found relevant was a letter of my employer citing my job and responsibilities.
what i mean is do i have to submit all the requirements like high school diploma,college certificates,experience cert.,police clearance etc.from the 3 countries that i got these clearance before besides i never got out of canada since i came in.so is it ok to just submit a copy as i dont have the originals.or do i need to submit all these.Is the letter from my employer just fine?
i just want to make sure everything is ok bfore i will submit my application.

Shaira,

I think what CIC meant to apply outside Canada like NY Buffalo, is applying as a live in caregiver from the beginning. Like the years and time you have spent here are wasted. Its like going back to zero.

would you mind if i ask you how many more months do you lack to complete the 24 months?

did you hear about "bridge extension"? i am not sure if this will help you too.

did you try calling the cic again? they may have other options for you. or better tell them the reasons why you cant make the 24 months in 3 years.

yes,what i mean is the requirements

i need 5 more months.i read about bridge extension but that is only for 2 monhts and i didn´t ask cic either.i have´nt called them recently maybe i´ll try again.
my reason is very simple can´t find employer at the time.i wasted 3months for one employer waiting for lmo and did not tell me he was denied, waited 3month process time for
my next employer to be ended up being fired coz of mis-understanding, i ask for OT pay but you know i can´t prove that either i even report them to labor standard but nothing happened coz i lost my copy of my contract,i phoned cic to get one but it went nowhere so i forget about it. we just had a discussion the next thing i know i´m fired.finally i found another employer again,after a few months she went to the hospital and never came home.so igot another employer this time, to make up with time lost iwent to the MP hoping to expedite my papers and you know what happened?it ended up too long coz the person in charge got sick for a monthn so my papers got sick too isn´t it funny?
do you think that is a good reason?
cic actually told me about applying PR in another route but it is not 100% approved i would rather start over again than to gamble.
just telling you how i ended up with this.poor me.

Why dont you call CIC again and tell them every thing that happened. they might consider your case. you wasted 1 and a half year due to circumstances beyond your control.

please gather and prepare your papers in case they insist you apply and back to zero again.

REQUIREMENST: Temporary work permit application outside Canada.

i did some research for you, if you have to do application from outside canada. i got this from CIC Buffalo site:

APPLICATION GUIDE AND FORMS

Electronic submission of the application form is not yet available. You must print the application form and submit it by mail. We do not offer pre-assessment or counselling services. Submit your completed application with all your supporting documents and the appropriate fees and an Immigration Officer will assess it.

REQUIREMENTS FOR ALL TEMPORARY WORK PERMIT APPLICANTS

1) Application for a Work Permit made outside of Canada (IMM 1295) (PDF* 221 KB) completed and signed (The Guide "Applying for a Work Permit outside Canada (PDF* 237 KB)" will help you complete the application form properly. The Guide also contains important information on such issues as maintaining your status and that of any accompanying dependants while you are in Canada, your permitted length of stay, documentary requirements when travelling with children, etc.)

2) All items indicated on the Document Checklist (PDF* 29.4 KB)

3) Proof of lawful status in the United States or Canada.
If you are a citizen of the United States, please provide a photocopy of one of the following documents:
US passport
Birth Certificate
Naturalization Certificate

If you are in Canada with temporary status, please provide:
A photocopy of the page in your passport on which your entry to Canada was authorized and
A copy of the document issued to you by Canadian authorities to confer that status (Work Permit, Study Permit, etc.)


4) A letter of reference from your current employer describing your job duties, length of service and salary.

5) Photocopies of educational or trade certificates, professional licences or apprenticeship papers.

6) If you are applying for a TEMPORARY WORK PERMIT in a validation exempt category and do not require an HRSDC-confirmation, you must provide:
a letter from your prospective employer describing your job duties
anticipated duration of employment and
salary.

FEE PAYMENT OPTIONS

You may pay fees in Canadian or US dollars. See the Fee Schedule

Fees must be paid by certified cheque or money order (if applying in person, fees may be paid by Canadian or US cash in the exact amount of the fee).

The fee must be payable to "The Canadian Consulate-General

The fee must be drawn on a US or Canadian bank

PASSPORT VALIDITY

If you are from a country whose citizens require Temporary Resident Visas (TRVs) to enter Canada, your passport should be valid for at least 3 months from your intended date of arrival in Canada. If your passport is nearing expiration, you should obtain a validity extension or a new passport prior to submitting your TEMPORARY WORK PERMIT application.
MEDICAL EXAMINATION REQUIREMENTS for VISITORS

You may be required to undergo a medical examination.

PROCESSING TIMES

Most applications are processed within 1 - 28 days. Please see processing times.

Mail-in applications will face longer processing times than in-person applications.

now I am looking for the application forms.I´m a little confused, which application am going to submit.TRV or extending my stay?Or TRV and write on top of application "re-entry into live-in care program"? does it make sense since am holding a current WP which expires next year.or application of WP made outside of canada,and write on top re-entry into live -in care?.oh God I dont know which one.Please can anybody help me sort it out!!!

Your case is very complex but no worries theres always a solution to it.. Did you get any refusal or anything from service canada.. Because you have met all the other requirments except for 5 months in which was all natural things and you could not control over.. The best thing to do is to go for humanitarian and compassionate grounds or judicial review for your case..As you have put in manu efforts..Well I hope that will solve your problem..Also pamaper nickle has given excellent advisee.. But my question to nickle is that cant saira apply for H & C in her case I guess it has a strong base only if her case has been rejected before.. Saira when does your workpermit expire?? Also in regards to the documents if you dont have originals contact CIC they will provide you with better solution..Best of luck

Please go to the cic-buffalo site. you may download the forms needed there. IMM 1295. and the rest. i also read the document checklist and six photos are required too. but please have them all printed out. you will need TRV in case they insist you start your application from the beginning. try contacting CIC also if they have other options like H and C as Gurpeet suggested too.

where in Canada are you? think its better by phone helping you.

if i were you i will try thr luck of H and C. who knows? there may be a spot for you waiting there.

Yes, that is what the cic lady told me go for HC
but that would be a lot of interview and such and not 100% sure.all my docs is ready just need more ideas.did anybody applied for HC before with same situation as mine?

thank you gurpreetfor your insight ,i try all possibilities.itried getting a copy of my contract before at cic and they pass me to so many offices,nobody knows where it is so i gave up phoning.

I could help you Shaira but I would be terrified to meet with you in person, since whoever you approach seems to vanish at the Hospital or get sick and be done with (life?)!! However, it is gonna cost ya something like US$5,000. Let us talk if you have the money. Without early payment, of course, nothing will can be done. Anyways, good luck resolving your very messy situation. Overtime? What OT?
