Subject: Drunken driving -over 80 mg- charged
  Hi guys,

I feel so stupid to this but last week, me and my friends partied and i tried to drop off my friend home and was pulled over by cops and changed with drink and drive. While i was caught i was not driving crazily or anything. Now they asked me to give finger prints on a particular date and attend the court on another date which is 2 months away.

My question is: i was planning to renew my travel visa there is a question: Committed, been arrested or charged with any criminal offence in any country? --- Should i say no or yes as my case is not convicted yet.

Will the information from cops reach the immigration from last week to date ?? if not can i say no and apply through post ??

I am scared..i am in deep shit..I m currently on Workpermit till end of 2010..i also applied for PR under Canadian Experienced class and waiting for my medicals ?? will this spoil up too ??

I need some support from you guys as i can´t reveal this to my friends..i am really ashamed of my self for doing this....

Can´t afford to live every day with the guilt..


Please some one help me and guide me what to do...I´ll be indebted to for the rest of my life..

have you been arrested - yes. have you been charged - yes. so, how do you think you can answer no and not commit misrepresentation while you are at it. Postmark roulette is a foolish game to play.

The only way the charge will not affect your PR is if you are found not guilty.

Google the Canadian Criminal Code there is a section that no conviction will be registered based on certain criteria. I think CCC 253 (5) You need to seek alternative treatment because.....

DUI is an offence in Canada. You have to answer yes, you have been charged and arrested.

There is a 99% chances that your visa will be rejected now and if you don´t tell the truth there is a 99% chances that you will be charge for misrepresentation. Either way you´re toast.

And yes, it will affect your application for PR. I am not sure to what extend and it will affect it either way.

This is not a pretty thing to hear but......
If it happened in the US, it is already at the CBSA database.

what advice do you want?

DUI is a serious offense in Canada. I was charged for driving without insurance when my application was in procces for PR and I asked the cops if its gonnabe on my criminal record, they said no, but if it was DUI thats a criminal record.
