Subject: Can I take my son without consent the father?
  Hi,

Hi I am a Filipina, My husband wanted me to follow him to Canada

My problem is that I have 4yrs old son, he is using my last BF´s surname (acknowledged n Birth Certificate)
It´s been 3yrs that I do not know whare he is, we never received any financial support from him eversince.

My Questions:
1. Can I take my son even if he is not adopted/using my husband´s surname?
2. If yes, Can I take my son without his consent?
3. What are the documents I need to show to immigration?


I hope you can help me. I cannot leave my young boy alone here

1. Your son can be sponsored as your dependant and your son´s last name doesn´t matter.
2. You must have consent from your son´s father before CIC will approve the application. It needs to be a letter indicating that he has given you permission to take his son from the country.

Maria all is not lost.

When a child is born in Canada neither biological parent has LEGAL custody of that child. Your son is your son and the biological Father is located at __________!

Go to the Biological Fathers family and get them to sign an affidavit that they do not know where the Biological Father is and they are not opposed to allowing your son to immigrate.

This is a standard procedure.
