Subject: In Process Status Update
  Hi, I had filed my application for immigration at New Delhi(India) Consulate on March, 2008.

Recently there my application status has been updated with following message:

"We transferred your application to the Sydney, Nova Scotia - C-50 office on March 2, 2009. The Sydney, Nova Scotia - C-50 office may contact you."

Can anyone please let me know, is this normal that applications from India are transferred to Nova Scotia? Someone told me that this has happened probably due to your case being processed in ´fast track´ quota. Is this true?

You applied after the rules have changed, so, your file has been transferred to NS to determine whether your occupation falls under one of the 38 NOC codes. Check www.cic.gc.ca for details.

Need Help on application transfered to C-50 office (in reply to: In Process Status Update)
Hi I have applied for Permanent Resident Visa in Nov 2008, at that time I did not have AEO letter, I got it on 16 Mar 2009, but my application transfered to C-50 Office NS on Mar 12, Although I have mailed and Faxed the AEO letter to High Commission in New Delhi , Can I send the information to C-50 office in NS Does any body have the e-mail or Fax No of NS office. Pl reply.

FRIENDS I THINK ALL THE APPICATIONS GOING TO NOVA SCOTIA WILL BE SCRAPPED.AS MOST OF THEM ARE OUT OF 38 OCCUPATIONAL LIST CATEGORY.IF SOMEBODY HAS SOME OTHER LEGAL VIEW PLEASE TELL.THE IMMIGRATION SITE IS SILENT ABOUT ALL THIS.

Dear friends,

I am Bangladeshi and applied for immigration to Canada along with my family (wife and daughter of 2 years)from Germany (Berlin). I also got the same reply like..

`We started processing your application on June 9, 2008.

We transferred your application to the Sydney, Nova Scotia - C-50 office on March 16, 2009. The Sydney, Nova Scotia - C-50 office may contact you.`

I am also not understanding what it means and what the current situation of the application is. Could somebody send the link of 38 occupation? This is also beyond my idea. Please let us know if somebody has any clear idea.

Hi! Im from Philippines. I submitted my application last Oct. 2008 and I received a reply letter from the canadian embassy stating my visa file number and changes in the immigration law. As I checked my application status online it states they began processing my application Nov. 5, 2008. Last month I checked again my status and I found they added my mailing address and and is still "in process". It is also written:

We transferred your application to the Sydney, Nova Scotia - C-50 office on March 18, 2009. The Sydney, Nova Scotia - C-50 office may contact you.

I am confused. What does this mean? My NOC occupation is not listed in their "top demand 38 list in NOC". Is there a positive feedback on my application to be processed or to be rejected? Will I expect response within 6-12mos?

Hi faithp,

Based on the operational bulletin (guidelines) in response to the ministerial instructions published by the CIC web site appendix b - references that those FSW1 applications submitted on or after February 27, 2008 until November 30, 2008 should be assessed by the visa office where you submitted your application. It means that the visa office will determine the eligibility of your application based on the ministerial instructions for processing. If the application is approved for processing then the mission will enter code "1" at the paper screening (T-11) in CAIPS, if you did not meet the ministerial instructions then most likely your application will be refused and mission will enter code "2". Take note that applications submitted on the above date have some exceptions as stipulated in op6 "Someone who meets the requirements of the Ministerial Instructions today, but did not meet them on
the application received date, should be assessed in relation to today´s date and not the application received date. For someone who met the requirements as of the application received date, but no longer meets them, the reference point should be the application received date. The rule of thumb is to apply the requirements in a manner that favors the client. Applicants could not self screen before the Ministerial Instructions were made public." (8.2 page 16) but substituted evaluation could not be used to overcome failure to meet the Ministerial Instructions. Only you can determine whether you will be under the exceptions stipulated above. If they consider your application then it will go under further evaluation for processing if you really meet the instructions based on the documents that the visa office will require you to submit. I also have the same In Process Status but I think let us be positive and don´t give up. We have to do our part and pray that is what matters most. I say good luck to all of us who submitted the FSW1 application during the transition period between the old and new immigration law. Let´s pray that we see each other in CANADA in the near future...
