Subject: Removal Order
  Would like to know the possible outcomes of a removal order interview? Recieved a letter from CBSA "that our records indicate you are the subject of a removal order that is now in force". He already had an exclusion order in October of 2006. Some background on our case is an H&C application submitted in April of 2006 that was botched by our lawyer by having us change to a sponsal sponsership in Canada. I was denied as the sponsor becuase I was in reciept of social assitance at some time in those last 3 years. We are now submitting a new application. My question is if a removal order always guarantees that the subject will be romoved from Canada, whether it is that day or x amount of days later. tia

He will be removed from Canada, If i were you i Will file a outside spousal application for him he will need authorization to return to Canada.

If they do ask for his home phone bills do not panic.

If they don´t the following will take place.

The issue is everyone is entitled to a PRRA Pre Removal Risk Assessment application. That is new evidence from the time you were ordered way back when until now that shows he is at a risk to his life.

You will be given 15 days from the date of your innitial PRRA interview to submit the forms then an additional 15 days to submit submissions. (reasons)

Now one can blame counsel all they want but you know that on the undertaking the question was asked if you are on social assistance and you checked of NO.

Then Nanette you went on welfare while your husband was here and probably working. If he was not working he was not showing sufficent commitment to you anyways. H&C switched to a spousal is logical because the two of you got married. The big mistake was to submit a H&C if the two of you were intending to wed.

Take some of the blame and blame counsel to his Visa Post if former counsel has many clients from that Visa Post. When passing blame around you can nopt use what you said above.

It does not make common sense.

Actually the lawyer admitted his guilt that it was his fault. The H & C application was submitted in 2006 and 3 months in 2007 I was on social assistance which wouldn´t have matter in an H&C application. In July 2008 we signed a document presented to us by the lawyer to switch to a spousal sponsorship because it would speed up our process. So when original application was submitted in 2006 of course I would check no to being on social asistance. His job as our lawyer was to inform us of the conditions of a sponsor when switching applications. So sorry but none of the blame is on us. Sometimes Lawyers do get it wrong!

He had an exclusion order in October of 2006 so he was an overstay before that!!!!!

So the H&C for your partner was submitted in 2006 and you guys were living together. What did the form say never married????? HE HAD NO SPONSOR! NOT MARRIED OR COMMON LAW, WHY?

In July of 2007 you were on welfare for three months, been there done that.

YOU SIGNED THE UNDERTAKING OF ASSISTANCE IN JULY OF 2008 WHILE YOU WERE NOT ON SOCIAL ASSISTANCE AND GOT REFUSED BECAUSE IN 2007 YOU WERE ON WELFARE?

Any time on welfare after signing the undertaking would make you not eligible but because you were on welfare in 1975 means nothing.

YOUR DATES MAKE NO SENSE.

Regardless he was here when you went on welfare and that shows lack of commitment from his part to support you.

Keep totally blaming others, accept no blame for your own actions and keep saying Billy made me do it. ARC will be refused.

As long as the CBSA has knowledge that you were on social assistance while a removal order was enforced on you you will be regarded as a drain on societal resources and removal will be executed. Be warned!
