Subject: Applying FSW using the 38 priority professions
  Hi, I´ve been waiting for my medical for more than 2 years without any update. According to the new rule, my wife´s job is among one the the 38 priority professions listed.

I´m wondering since I´m clueless about my application´s processing time, is it wise to just cancel my current application, and apply a new one using my wife as the main applicant? I´ve tried contacting a lawyer and asking him about it, and he said that it will take only 6-8 months if the main applicant´s job is included in the priority professions. Is this true? cos if it is, I will apply a new one, I don´t mind paying for fees again.

I´m confused, so what should I do? Thanks a lot...

To be honest your lawyer is not right . I wonder how it might take 6-8 months while background security check after medical takes around 8 months !!! I suggest you better stick to your application and wait .

Firstly, Can your wife apply as a principal applicant-new under 38 list-when your application is pending ?
Check... Mostly YES...

If yes, you should not withdraw your application and wait for its processing. As soon as processing of one of the application starts withdraw the other one and save money.

It may happen(mostly not) that both application starts processing in short duration to each other, leaving no time for you to withdraw and save money.

You will loose application fees on one of the application and for that you are prepared.

Think the options.. but do not withdraw your application at once...

is that possible? I know that we can´t apply 2 applications simultenously. But if the current main application is under my name, and the new main application is under my wife´s name, will it work? Can I apply 2 applications simultenously? I don´t want to get blacklisted by the CIC for having multiple applications. Thanks

yes, you can. New Immigration process suppose to take less time. But again, we don´t have any clue ..not yet

As per the the Ministry´s instruction released in late 2008, processing time is between 6-12 months for application which were accepted thru the 38 priority occupations...

If your wife has at least 1 year experience in one of the the 38 POL then she may qualifiy to apply under the Federal Skilled Worker Category... When did you submitted your application? Which Canadian Embassy? Those applications which were submitted prior to Feb. 27, 2008 will be assessed using the old process wherein processing time can be up to 5 or 6 years (will depend on Visa Office)... you mentioned you waited for 2 years already...

If you want to explore if it will be on your advantage (processing time wise) for your wife to apply as the principal applicant then email me your wife´s current resume with her work experience within the last 10 years with detailed job description... for FREE initial assessment... If she will qualify under the new instruction then I will suggest or inform you your options and it is up to you and your wife to decide on how to proceed.
