Subject: Over staying temporary visa then applying for PR
  Hi,

I have been with my fiance (Canadian citizen) 3 1/2 years traveling in and out of Canada. Basically my first visit was for 3 weeks then I went home, came back 1 week later for 5 months then left for 2 weeks and returned 2 weeks later to find out we were pregnant, so I extended my temporary stay to have our daughter in Canada. I then however over stayed after my visa expired for 16 months. During my time in Canada I haven´t broken any of the other rules like working and studying or criminal activity etc and my fiance has supported me.

I left Canada for 6 months and recently returned. As I was able to return to Canada I am wondering if my over staying isnt such a big deal? We are getting married in May and have to extend my temporary visa at that time too..we plan to apply for my Perminent Residency from inside canada in September when we have my passport amended and marriage certificate etc.

Does anyone know how big a deal it is to have overstayed when applying for residency?

You are going about this the wrong way! Focus on proving your relationship.

Everyone should normally submit outside of Canada because you have an appeal option and it is way quicker especially if you are asked to attend an interview.

When you tell the truth they will know by the question on cohabitation that you have overstayed.

Overstaying does not make you inadmissible. Explain your reasons why. From your posting I believe your from a CVV exempt country and all you needed was a plane ticket to visit.

The fact that you two have a child and his name is on the statement of live birth is WAY insufficient to prove the bond between the two of you. The onus is on you and with all the bogus marriages around you will need all kinds of additional stuff to get Vegreville CPC to approve.

Thank you Roy, So the fact that I was out of status wont mean they will automatically decline my application?

I am from the UK so don´t need a Visa for a 6 month visit. We have things like Joint bank account statements, phone records, Joint Credit Card statements and statements from people that know us, plus my fiance has met my family and I can get statements from people that know us.

Is there anything else that could help prove our relationship?

Hi! I want to apply for the skilled worker permanent visa in Canada, but before that I would like to know if my case will be automated rejected if i stayed illegal for 6 years in USA (working) but no criminal records, or deportation or anything like that, with a background clean. I am back to my country on my own decision. I was cheated by a person and finally I discovered that I was already illegal, and we decided to keep staying and not going back to our country (husband and I). Can you please help me and advise me if I have a chance to enter anyway to Canada regardless of this situation?
