Subject: Married Outside Canada, TRV denied, what next?
  My sister married her husband last month in his home country. He had been in Canada on a 6-month TRV and they returned to his country, got married, and then she went back to canada and he stayed with his family for Christmas.

Last week he applied for a TRV because they had the idea that he could get a TRV and then they would apply for Spousal once he was in Canada. My sister wrote in her letter of invitation that they had gotten married, but they did not file for the Spousal visa at that time, just for a TRV. Of course, he got denied for the TRV. So now he is in his home country and she is in Canada.

He wants to try again for another TRV. He seems to think he can get approved for a TRV and then do the spousal. To me it sounds very improbable as I don´t even know that he will get approved for spousal (there´s quite a few things that make the application seem odd -- he has no job, no degree, didn´t finish high school, hasn´t been employed for over one year, she has a well paying professional job with multiple degrees, is 10 years his senior, they´ve only known each other 18 months and only been together for 9 months of that time, 6 of which was him on the TRV unemployed on her couch in Canada).

What should they do? Should he apply for another TRV? Will he even be allowed to do this -- use a TRV to enter the country and then switch to Spousal? Or should they just start the process for the Spousal visa with him applying from outside the country? What would be their best hope of getting him to Canada?

He has almost no chance of getting the TRV. Your sister should start the spousal sponsorship (outland). This process is faster than inland sponsorship and there is an option of appeal. However, they will be separated till he is approved as a PR and lands.

I am sorry for sounding so blunt, but for your sister´s sake she should get out of this relationship!
Is she sure he is not using her to stay in Canada?

haha -- yeah that´s what I think too -- but I´ve met the guy once and he seems too much of an idiot to even be able to come up with that scheme.

It is always easy to find another man, perhaps cleaner and more entertaining, as long as your sister has good income and is cute. Afterall, this all boils down to boy-toy at best. I know one guy who services a few Canadian women (these are professional women who are obese and most Canadian men shun them without looking at them twice) and both parties know it is a pleasure thing. Your sister needs to first make sense of her pull toward men before committing to this guy. He will become a more serious burden once she has babies with him and possibly become too ugly for any Canadian men to stand her! While she got her looks intact, it is time to hunt for a reasonable man (Canadian preferably, to avoid CIC deals) and enjoy herself.
