Subject: Difference
  Hi,

I understand if visit visa is expiring on 15th December 2008. One can enter in Canada by 14th December and will automatically get 6 months STAY i.e. till 14th June 2008(under normal circumstances).

1. When you talk about visa extension, is that mean you talk about extension of stay?

2. Would it be possible to get extension beyond June 14th since actually visa has already been expired on December 14?

Kindly enlighten me on above.

Visa is the stamp on your passport. It allows the entry. Stay is officially referred to "status", which is your status of residence in Canada after entry.

Date of the visa stamp has nothing to do with the status. The dates of the visa stamp allows you entry into the country as long as the dates are valid (not expired). If the date on the visa expires, you have to re-valiadate the stamp by issuing a new one.

Once you enter, you will be given a legal residence / status for limited period of time. You can apply for extension of this status while you are in Canada as long as you do not reach the maximal time of allowed for your status.

Based on the above, you can have a legal status while the stamp is expired. For example, the stamp expires on Dec 1, 08, you can enter the country before Dec 1 and will be given 6 month-stay as a visitor status. Therefore, you will stay in the country until 6/09 while the stamp is already expried. However, if you leave the country during this time, you have to get a new visa stamp because you can not enter the country without a valid stamp.

30 days before the end of your temporary status, you have to apply for extension. Fill the required forms and provide a letter explaining the reasons for the extension and furnish the letter with the supporting documents.

I interpret this that you have a single entry Canadian Visitor Visa in your passport that will expire on December 15th 2008.

That allows the airline to allow you to board the plane as long as you arrive in Canada prior to that date without facing removal costs.

The length of time you are admitted into Canada is decided at the Port of Entry based on your answers and there is no guarantee that you will be admitted for a day or six months!!!!

Thank you very much for your detailed answer and yes this is what I was looking for. Your answer has cleared everything now:)

Dear Roy, I would also like to thank you as well. Actually my 3 years multiple entry visa got expired on 10th October 2008 and I came here on 5th October and have been granted 6 months. So basically I will have to apply for the extension of my status, as Anonymous said.
