Subject: Process for my fiancee to move to canada from USA
  HI, my fiancee is from the US and i am from Canada. We are planning on getting married in the new year and have been together for over a year. I have gone down there and he has come here to visit me and my kids. My question is how do i go about the immigration process to get him here? Would it be easier for us to get married first? Should we get married in the US or Canada? And how long do i have to work for before i can sponsor him? Once here can he go to work right away? Its solemly me sponsoring him and i have not one else to help or anything, so i hope myself not making a whole lot of money can be approved. Also as the process is goign through can he stay here with no visa or anything for 6 months? Please help

where you get married is irrelevant. question is are you going to apply as common law (1 year of provable cohabitation) or married.

if you are a Canadian citizen you can be in the US while you sponsor but you will need to prove you are returning to Canada.

if you are PR, you must be in Canada to sponsor. In both cases, your income is not relevant.

avoid an inland sponsorship - it takes far too long. he cannot work until he has been issued an open work permit under the inland application and that can take up to a year. Don´t do it. Instead, bite the bullet and do an outland where you are technically living apart. Process take significantly less time and there is an option for appeal should things go sideways.

Yes were are gonna apply as married cause were gonna do that first, which is what we wanted to do regardless of immigration, we do love each other and want to spend ourlives together. I am born canadian and will do the application from here.Anything to make the time go quicker...Any other advice i would appreciate.

when you are preparing your application there is a little section that asks about your relationship - THIS SECTION IS VERY IMPORTANT. You need to make the case that your application is for a genuine relationship and is not just an immigration opportunity. Thinking that you love each other does not cut it. Put emotion aside and prepare your application like a lawyer would present a case at a trial. Every piece of evidence helps build a case. 100 wedding pictures can all be staged (they have been before). Casual photos, leases, telephone bills - things that show you have been together for a long time and that marriage was the next logical step.
