Subject: PR ap. in process for 3 years can we leave Canada?
  We sent in my husbands application in Nov. 2005. He got first stage approval in July of 2006. His file was transfered to the local CIC Vancouver office in October of 2006 and we were told that it could take up to 16 weeks. At that time CIC Vancouver had an e-mail address and they said that if we had not heard anything in 6 months to write back. August of 2007 still had heard nothing only now the e-mail was no longer in service. Called the CIC hotline and they didn´t even have the most recent info on his file and said there was a delay due to his kids from the USA from a previous relationship. CIC Vancouver had already delt with that issue and my husband signed a form stating that he would unable to bring his kids to Canada a later time. So we wrote letters both to CIC Vancouver and to the Vegreville CIC office. We got no response. We had started to plan a trip to his home for Nov 2008 as our neice was born in 2006 and we were to be her godparents and have to attend the ceremony. Since we were told 16 weeks we figured this should not be a problem. Well Jan 2008 after not being able to find out anything about his file we got in contact with our MP. He was able to find out that the file had been transferred for further background checks and the CBSA had it. We later found out it was in process. June of 2008 my husband was called into the CBSA office for an interview. We found out some of the issues:
1. We had not wrote in his file that he had entered the US on a plane enroute to Canada and was detained, interviewed and returned to Mexico. He was not allowed to enter the US because his familys application had been rejected and he was filed under his familys application. We did include all the deportation from the US info on his application and its not like he was trying to enter the US illegally as he used his passport and was on a plane.
2. He had been a member of a gang in California when he was a teenager. He has been out of the US now for 8 years. He has no criminal record. He already received his FBI certificate and state of california police clearance certificare.
3. There was an incident in September 2006 at our house where the police were called to our area and he was intoxicated. Some youth from the alley behind us had been throwing rocks and a fight nearly broke out. It didn´t though but most people were hand cuffed but no one was arrested and no charges filed. He was accused of being a MS-13 gang member due to one of his tattoos. He has never been a part of this gang. He since has covered this tattoo to prevent further mix up. The police returned the next day and apologized for what happened.

The CBSA agent said that he would go over the interview and needed on more document from the US and would call us in a few weeks. After a month we called him. He said he had what he had got what he needed and would make a decision by the end of July. That turned into August, and then September and we haven´t heard from him in probably a month.

We have been dealing with our MP again but the CBSA agent is not resonding to him either. We need to know if we are going to be able to leave the country for 3 weeks and it is only a month away now. Is there a special document he could get so that he will be able to re-enter the country? He has had a work permit for 2 years and has applied for an extension again but I don´t think he will have it before we leave. We have 2 children together and me and the kids are all canadian citizens. Any suggestions for what we should do are greatly appreciated!
