Subject: Removal Process Failed Refugee
  To All

For those that simply can not understand what happens or what other options there are to refugee claimants here is the process. If you believe you have an unusual, undeserved or disproportionate hardship you can file a simultaneous Humanitarian and Compassionate (H&C) while the IRB process your refugee claim.

If you loose your refugee claim you can file an application for leave to appeal to the Federal Court. Very little chance of success. When you loose you can also submit a H&C application.

Having a H&C application in process will not stop the removal process.

Having a In Canada Spousal Sponsorship will defer your removal if it was submitted prior to being called to the Pre Removal Risk Assessment (PRRA). Submitting a In Canada spousal sponsorship after attending your initial PRRA interview will not defer your removal.

When called for a PRRA you will have 15 days to complete the forms then another 15 days to provide any NEW evidence to show that you have a rsik to your life if returned to your country of origin.

The odds of being called for a PRRA prior to obtaining a travel document for you is EXTREMELY low especially if your from a country that will not accept you back unless you have a passport for that country.

Today in the Toronto Sun is an article about my clients that claims "family loses their bid to stay" in Canada.

They did not lose, they were only told to apply for a Chinese passport. It takes three months minimum to obtain a Chinese passport and currently the mother has already applied and not received any passport and it has been four months processing for her already.

Little upset by the title but I have only begun to fight. Stay tuned.

I have a family friend who has been living in Canada for last 6 years. He filed immigration under Refugee claimant and also filed the H&C. Both got rejected and his PRRA got rejected as well. He has been ordered to leave Canada in 6 weeks. He has a house here, him and his wife have full time jobs and he has a daughter who has never been back home to Pakistan. They prepared the case showing that their daughter has never been back home and she wont be able to get the proper education and adapt to the culture but i guess that didnt mean anything to the Immigration people.

Is there anything that could be done except buying some time?

The situation in Pakistan is not good but still their case has been rejected.

Any suggestions????

People in the Immigration HELP Business when asked this question will normally always say yeah there is lots one can do. Put the money on the desk and I will help you!

They have to pay their bills too! Others have trouble paying their bills like me because if I do not like what I see in the mirror in the morning I can not go to work.

When it comes to the government kicking out Canadian Children I´m on a mission. Wait for the Saturday TV News.

Being a Former Program Specialist in H&C plus years as a Case Processing Officer with CIC I understand the way the Immigration Officers assessing ones H&C looks at their application. Everything that should evoke compassion has to be included.

Jealousy enters into the process greatly with the CIC decision makers.

Understand clearly that the Refugee Board IRB assesses the refugee claim. Too many H&C applicants focus on the failed refugee claim which is something the Immigration Officer can not revisit! Persons working at the IRB get paid much more then the Immigration Officers.

Immigration Officers are furious at the success rate of Refugee Claimants (48%)
Immigration Officers are furious when asked at the time the Refugee Claimant gets Landed "What do you mean I am not suppose to go back to my country?"
Immigration Officers are furious when checking up on ones residency that they have been out of Canada living in the Country they feared persecution from.

Now the fact your friend has a house is good but the CBSA Officer when they were called into their initial PRRA interview did tell them the decision could be negative and they should start preparing for the outcome being negative.

Here is the best solution if certain things in his/her personal circumstances are correct.

Apply for a HRSDC LMO and then when home with his confirmation of employment apply for a Temporary Resident Visa WORK PERMIT.

Sometimes when you lost the fight you have to admit that it is over too. Sorry!

Hi Roy,
My cousin got refugee claimant in Canada in 2006. After required period of time he applied for CDN citizenship in 2009, which is still under process and have been forwarded to the immigration/citizenship office nearest him.My cousin is from Pakistan and his father is having a heart surgery and he wants to go there for 15-20 days.he hasnt gone back home since 2003. As a refugee claimant against Pakistan, will authorities give him hard time if he goes to pakistan for few days to visit family?Any advise will be much appreciated.
