Subject: Question regarding applying from USA
  Hi,

I have a question regarding the Immigration office that I should apply to for PR. I am an Indian and my current US Visa is valid till Jan 2010 which might get extended. The website says that you can apply to the Buffalo office if you have been lawfully admitted into the US for a period of at least one year. What does this mean?

1. Is it that my US Visa should be valid for atleast one year from the date of my application? or
2. Does it mean that I should have resided in USA lawfully for the past one year from the date of my application? or
3. Does it just mean that the validity of my US Visa and my I94 have to be atleast for one year?

Hi

It means you can apply if you have resided in US lawfully for last 12 months...

You do not have to necessarily reside for one year. If you enter US with one year student visa or 3 year H1B visa, you can apply as soon as you can get an address in the US. However, if you entered US with six months visitor visa and extended it for another six months (total one year) then you cannot apply through US.
