Subject: immigration to canada spouse case
  I live in India and got married with a Canadian PR in may 2007.
Earlier my spouse was married in Feb 2005 and as soon as her former spouse entered in Canada both got separated and divorced. When my spouse in Canada applied for my visa it was refused bcz the three years of her earlier sponsership were not completed.Now on Aug 8 three year are completed, plz advise me whether my sponsor should apply again. Will we have not to face any problem bcz we did not appeal against the refusal.

there is no point to appeal a refusal - rules are rules.

Her first husband landed in August 06, they separated and divorced, and the 2 of you married 9 months later - correct?

You are going to have to prove to CIC that your marriage is legitimate and not the same situation as the first marriage. All I can say is good luck.

If you can prove that the first marriage was not a MOC then you have a chance. Otherwise say goodnight!
