| Subject: H and C for Sister |

My sister just arrived from London where she is a Citizen. She has no relatives in London. She wants to apply for PR under H and C. Can I be a sponsor? Would CIC consider me an eligible Sponsor? A sister.
Or should she send in the application without a sponsor?

I would advise not to go for H&C application because it is such a complicated process that if you do not get first stage approval from Vegreville then your file is stuck for at least 5-6 years and you have to mantain your non-immigrant status and apply for visa extensions every six months (if you are on visit visa). There is no guarantee that you will get the extension until a decision is made on your application. H&C is something which is totally in the hand of visa officers because there is no defined criteria of selcetion under H&C. So you can play your gamble, if the visa officer is in good mood and and he/she feels like approving your application, you would be lucky and if the visa officer had a fight with his/her spouse then you can imagine what would happen to your application. If you like to take your chances, go ahed otherwise i would never recommend H&C to anybody. I made this mistake in my dad´s case and his application is full with dust in any cabinet at CIC, Scarborough.

Thanks Mike. You are great.
But can I also sponsor my sister? On the H and C form there is a part that says if you have a sponsor, go ahead and fill up the sposnorship forms along with the H anc C forms. Is a sister qualified to be a sponsor?

well, sponsorship is not a requirement for H&C applications because you are asking a favor for special resons so sponsorship is not required. But i would defintely affect the outcome of the application. I filled the sponsorship forms for my dad and my income was less than the low income cut of (LICO) i noticed that it did affect the decision on my dad´s application and he did not get the first stage approval. I think you can lawys fill up the sponsorship forms however, please make sure that you have enough funds to show and prove and you have some genuine grounds to convince visa officers for H&C approval. So be very persuvasive and give some genuine reasons to ask for PR through H&C. The answer of your question, i belive is that yes you can fill up the sponsorship forms. The best person git advice on H&C is Roy Kellog. He regularly visits this forum and answers inquiries like this.
google search ROY KELLOG and you will get his website address and contact information. call him, if you feel like otherwise you can always get some advise through many members on this forum. Good Luck!

Thanks for the comment though. View the situation and understand why are you focused on H&C?
What unusual and undeserved hardships does your sister have instead of just wanting to jump the queue?
Is your sister working then find her a position and get her a Work Permit. Way faster processing times and it will not be a waist of processing fees.
