Subject: PR expired but living with Canadian Spouse
  Hi,

My father was a permanent resident who never got his citizenship. Since 1998, he has been living overseas, thus not meeting the residence requirement. However, all this time, he has been living overseas with my mother, who is a Canadian Citizen.

I heard somewhere that in such a case, his living with my mother is considered the equivalent of living in Canada, thus meeting the residence requirement. Is this true? I found it on some immigration websites, but still can´t locate where it is stated on the official CIC website.

His situation falls under the old and new Immigration Acts so why go there. Have her sponsor him since income is not an issue while she is living outside the country.

What you really need is not a web site but the act and relevant regulations.

Our biggest problem is that, due to family circumstances, we need him to get here as soon as possible for 2 weeks.

We might have to apply for a visit Visa, but the embassy said that he would have to give up his PR first before applying.

I just figured that getting him a temporary PR-card on the basis of his wife´s citizenship might be a quick way to get him here.

Any advice?

I think that he should be fine.

He first need to take a one time entry visa from the home Canadian consulate and after coming can apply for the permanant resident card.

The issue here DC is that the whole thing is very urgent and we do not know from which country they are residing.

I doubt he will get a one time entry visa because they appear to have already discussed the issues of non-compliance with residency requirements with the Visa Post.

It would probably be faster to apply and receive a single US visitor Visa then drive into Canada. Drive into Canada and the Americn´s will not take him back into their country if the CANUCKS refuse entry they have no choice but to leave him on the bridge for ever or admit him.

Just a thought!

I have never seen anyone at Peace Arch Park with a tent so Roy... you may be on to something!

My impression is that, they even aren´t considering to re-validate the PR status first. They tried t get a visitor visa and the embassy suggested to get rid of the PR status in case they want the visit visa.

If they would directly apporach for the one time entry visa for the PRs showing proof of relationship with his Canadian wife then it would´ve been easier, I believe that it would be even faster than getting an usual visit visa.

Depending on his nationality, getting US visitor visa can be a million dollar winning luck play. By default I assume that he is not a US visa waived nationality as he needs a visa to enter Canada.

Idea of camping on No man´s land seems very interesting. I would be watchful next time if I drive cross the border.

My parents reside in the United Arab Emirates, so that´s where they are applying from.

The person at the embassy seems very ignorant of the potential solutions. Apparently, he kept repeating that he must relinquish his PR in order to apply for a Visa - not taking note of the situation of living with a Canadian spouse. Apparently, a visit visa might take 2 to 3 weeks, which is past what we´re looking for, but it looks like my parents are still going to give it a shot.

I just regret them leaving it to the last mintue instead of working on it earlier. Ah well.
