Subject: Sponsoring Wife?s PR while in US.
  Hi
I got Canadian PR last year after entering into Canada i came back to US. I am working here on H1B.
I am planning to move back to Canada on permanent basis sometime next year so that i stay there for 2 out of 5 years and don´t lose my PR. I have a question if i get married in India and bring my Wife to US on H4 visa can I apply for her immigration to Canada from US. How long do I need to wait before I can apply from US. Where can I find more information about this online or somewhere else. If I can´t apply from US and need to be in Canada when I apply then how long do I need to wait before I can apply, do I need to wait until I file my first tax return to show proof of income. In the meanwhile can she accompany me to Canada on Visitor Visa and later on go to India to get her PR visa stamped once its approved.
Any information on this deeply appreciated.

As a PR CAN´t sponsor staying outside of Canada. You must be residing in Canada.

How long? Immediately. No need to wait for tax return for spoual application as from most of the province spousal sponsorship doesn´t need any min´m income.

thanks for quck response. Can she accompany me to canada in the meanwhile on Visitor Visa. I know it depend on luck but what are the chances from your knowledge/experience from diffrent forums that she will get visitor visa.
Since it will be less then 1 year for her in US before i move to canada so do i need to apply for her in india which mean she will have to go to canadian consulate in india when they call her for interview or visa..
Does it affect her case in anyway timewise if she is in canada on visitor visa while her application is in process.

Theoretically she can come as a visitor meanwhile. BUT, practically it is up to the visa officer. Some visa oficers don´t issue another type of visa while a PR visa is on the way. It is considered as dual intention. They interpret this as if your case is denied then she wouldn´t retun back to home.

But applying for visitor visa won´t have any negative impact on the PR application, even if it is rejected.

I can´t apply for her canadian PR until i am in canda so at the time when we apply for her visitor visa we wouldn´t have applied for her PR visa.

Can do it. However, keep it in mind that if you apply for her PR while she is in Canada then it may take a longer time to process.

What is the time diffence b/w applying from within canda and to consulate outside Canada. I heard it can take 9-12 months from with in canda and about 6 months to consulate outside canada. Does this sound correct. I guess this becomes real important factor in deciding weather to apply for with in canda processing or to outside consulate.
Can´t i apply for her to outside consulate lets say in india as she will have address there. When her interview or medical is up she can go to india and come back on PR in the meanwhile stay in canda on Visitor Visa.

I am in US right now on H1 so how long does she have to be here before i can apply for her PR through canadian consulate in Buffalo here. I know when i applied for my PR under skilled worker category i had to be here for 1 year before i could do it. Will that be the same in her case or can i apply immediately once she is here as this case will be under familly sponsership category i believe.

I believe that there is not any wait periord for spousal sopnsorship. I don´t know anybody sponsored in Canada personally, though heard that this process can be substantially lenghty compared to outside Canada ones.

You cannot sponsor her until you are living in Canada and showing work history.

once you do that, and you are married, you can begin sponsorship immediately.
