When one intends to submit an H&C application the best rule is to understand that the unusual and undeserved hardship not intended by the act or regulations is the key.

The focus has to be on "what was intended by the act and regulations" hence IRPA 3

So one has to start with the authors of the current Immigration Act prior to the current act being passed into Law. Any applicant has to start with the standing committee on citizenship and immigration, then the governments response etc.

All the while understanding that the Liberals were the government for many years and when they get quoted in the media as "the governments clear intention is to always treat applicants fairly" then you must pounce on quotes as that to show (you) are not being treated fairly.The Conservatives since coming to power have purged most of these comments so search in newspapers archives.

The other issue is does your application make common sense to you and two others? If so it will make common sense to an Immigration Officer.

Two many persons think and think and can not decide to go ahead and their window of opportunity disappears.

Any applicant can always add additional reasons after the application is submitted. When the CIC office decides to assign your application to an officer they will send out a letter to the applicant to update your forms and reasons for your application.

H&C applications made too late may never be assessed prior to your removal. Many refugee claimants wait until they receive a negative decision prior to submitting a H&C application. This is so wrong because there is no restriction on simultaneous applications.

Okay...i never heard any thing from CIC Scarborough, so far that means an officer is not yet assigned to my dad´s file.


Simultaneous applications means that my dad´s application on H&C grounds is in process and i have the choice to submitt another application under family sponsorship category.

AM I RIGHT?
