Subject: Abandoned skilled immig.applicant
  Hi to everyone who´s willing to help.

I´m an applicant for the skilled immigrant visa. Right now i´m on my second year of waiting. The letter that the embassy sent me said that my waiting period is 48 months. I put in my application that I am married (since I am, when i filed it). But my husband abandoned me late last year for another woman.

My problem is, what would be the implication of this abandonment by husband to my application? I´m the principal applicant and I included my husband and son as my dependent who will accompany me if ever i´ll be granted an immigrant visa. I haven´t seen nor heard of him since December last year. I don´t know his whereabouts and he hasn´t contacted me for any legal separation/annulment offer. I can´t change my information from married to separated/annulled since I don´t have proof that I am.

Please tell me what to do. I still have 2&1/2 years and the embassy might ask me to update my informations any time soon. Thank you very much.

I am not an expert...but if I were you... I would find the way to divorce him somehow... there must be a way... and then let CIC know of the changes in your marital status (send the divorce papers with a letter) and if you still want to go to Canada, carry on with the process...

There might be some complications with regards to your son though... you need to get some documents from your husband allowing you to take your son with you to Canada...

I wish you luck... and please wait for some expert advice on this one... I am sure others will reply with exact instructions on what you can do...

I think you can ask for cancelling your spouse´s application and fill in the forms again and ask for the refund of money you submitted for your husband´s PR.

One more thing, file a case with your local police station that your husband is missing (when you do not know his whereabouts, that means he is missing) and retain a copy of the DDR with you, even if you do not have the documents to show that you are seperated, you can still tell the consulate that he is missing and this has been reported to police and they are on a look out for him.

Hope you get an expert on this. Also contact a lawyer about this status of being married?? there is surely a way out.
